Prosecutors still insist that the person with his hand on the tiller of a drifting sailboat was at fault for being hit by a speeding powerboat in the dead of night.

The preliminary hearing on vehicular manslaughter charges against Bismarck Dinius, 39, of Carmichael, was held yesterday and will continue today in Lakeport in Lake County. The charges were filed as a result of the death of Lynn Thornton, 51, who was killed on the O'Day 28 Beats Workin' II on the windless night of April 29, 2006, on Clear Lake. Dinius happened to be sitting at the helmsman's position of the sailboat at the time Thornton suffered the injuries that would kill her.

We think that Dinius to defend himself on these charges is a travesty of justice, as what really caused Thornton's death is Russell Perdock of Lake County slamming his appropriately named Baja Outlaw 24-ft powerboat into Beats Workin' II at 40 mph or more. Why hasn't Perdock been charged? There can only be one explanation in our mind — he's the number two man at the Lake County Sheriff's Department, and law enforcement up there, based on this case, appears to be corrupt as hell.

Reads like it was written by a five year old. And the headline makes absolutely no sense.

was there any drinking? that’d be the only explanation for charging the sailboat owner.
we had a man parking his boat trailer and got tee boned by an old lady who died at the scene. anyway even though it was her fault, because he was drunk he got charged with vehicular manslaughter.

Agreed. I think a major part of the case will be about whether the sailboat did or did not have the running lights on. It matters.

He needs the help of a qualified marine accident attorney.

National and International law requires the right of way be given to the least maneuverable vessel. That is the basic accepted premise on which all laws of navigation are based, whether on land, in the air, or on water.

I was in a very similar situation in ‘87. I was hit while anchored at night. Long story made short, I prevailed.

Get a good attorney.

yup , as to the Running Lights

I did sailboat deliveries in my youth { early to mid ‘70s } from NYC area to FLA and back ( West Palm , Miami , Ft Laud ) ,.. and we’d “run dark” off South Carolina , Georgia and northern FLA because of piracy { true } and we were well armed

oddly enough , .. the Close Call was in the IntraCoastal , in The Virginia Cut on a warm , sunny October afternoon

but , I digress , .. running lights are a must on small bodies of water with mucho traffic , ... . we kept high-powered flashlights in the cockpit , to shine on our sails ( we’d look like an outdoor movie *chuckle* ) , and of course , the spreader lights
