So, who does have standing? According to the Hon. R. Barclay Surrick, that's completely up to Congress to decide.

If, through the political process, Congress determines that citizens, voters, or party members should police the Constitution’s eligibility requirements for the Presidency, then it is free to pass laws conferring standing on individuals like Plaintiff. Until that time, voters do not have standing to bring the sort of challenge that Plaintiff attempts to bring in the Amended Complaint.

IIRC, Clinton gave the enviros standing in an EO. I also recall something that shields them from being countersued because they will always be sueing the government.

This judge was certainly trying to pass the buck. He was wiggling out of having to make a decision while running out the clock. Typical of the legal system.

Does this mean that people cannot make a "citizen's arrest?"

Just who, if anyone, in today's government has "standing?" Why are they NOT standing? Being eligible to run for the Presidency of the United States is fundamental to our Constitution. What body or persons are responsible for vetting the basic requirements of the Constitution?

We are having right now a Constitutional Crisis, and no one seems to care in our government. What is going on? Are we already "cowed" by the Marxists?

This travesty MUST be exposed to the American people on national TV. This corruption and duplicity of the RAT party is a national disgrace. Surely, the GOP can find the money to buy air time. If not, send out an emergency plea to the GOP base to pay for it. Small price to pay for our freedom and future, IMO.

I believe that Barclay Surrick is dead wrong. But so is the DNC for not properly vetting the Obamessiah and the states for allowing him on their ballots, especially if there are questions about his eligibility.

In the event that he gets elected and is found later to not be eligible, America will have a genuine Constitutional crisis on its hands.

Also, since neither the Bush Administration nor the Congress will perform their sworn duties to protect this country and defend, protect and uphold the Constitution, the citizens will have to - especially if the states won’t!

Rule of law in this country is DEAD. This is how everything that challenges the new socialist agenda will be dealt with - a simple dismissal based on "lack of standing".

If we don't have standing as voters to challenge a candidate's eligibility, Congress offers no relief. We live in a country of men, not of laws.

Someone posted in another thread that this should be presented to the electoral college. Makes sense to me, but in the meantime, this needs action and widespread media.

Now is the time for a prominent, credible media person to champion this issue. Do it loud and do it until there is a resolution(produced authentic BC).

At this point Berg looks like an amateur. Standing is interesting. Obama gave the Court jurisdiction when he responded to the initial filing. IF it is true that Obama did not respond to the discovery then it should of been a slam dunk summary judgment. Looks like a Court punt and score for the bad guys unless Berg is working some angle I haven't thought of. This was always a cr$p shoot.
