HPD: Woman fatally shoots car burglar

A woman fatally shot a suspected car burglar Monday night in the parking lot of her northwest Houston apartment complex, police said.

The woman told Houston police she shot the man about 9 p.m. after she spotted him breaking into her car parked outside the apartment in the 5900 block of Pinemont at Alabonson.

Why would you think that. Being dead has never stopped a dim before. If ACORN has him signed up, he'll vote regardless of location or body temp.

Not legal in other states. If she was not in her car, she can’t shoot him because her life wouldn’t be in danger, according to the laws of most states. Look at the number of homeowners who have been charged after the fact when they shot an intruder breaking INTO their homes, or running away. I think most lawyers would advise if you are going to shoot a burglar, drag him inside afterward!

Or, perhaps the law of the old West prevails — stealing a man’s horse is a hanging offense. Updated: stealing a woman’s car is a...?

NEVER move the body. Modern forensics can tell if the body was moved at any point after it came to rest.

Even if it really was a good shoot, you will then go to jail for obstruction, falsification of evidence, tampering with evidence, and will be under suspicion of murder because of the above.

If you live somewhere with restrictive self-defense rules and it’s important to you, don’t think about moving the body. Think about moving somewhere else that doesn’t deny your right to self defense instead.

If someone is breaking into my home while I am in it, I can shoot. If they flee after seeing what was waiting for them in my home, I can not. The threat of bodily harm is over.

If your lawyer tells you to move the body, you need a new lawyer. btw, I am shocked at how many people say that asinine comment in this day and age.

He had a screwdriver in his hand. That could easily be construed as a deadly weapon. She was “in fear for her life”.

Heck, the police have shot and killer innocent bystanders presenting less of a threat and gotten away with it.

It made sense as little as 30 years ago, but today - oh HELL no. Modern forensic investigation techniques and technology are so good it’s scary.

I second that - if your lawyer tells you to move the body, get a new lawyer. Better yet, move to some place where that is never going to be an issue.

Again, NEVER move a body.

In Texas, this is not an issue. This was a righteous shoot - and in Texas, she does *not* have to be in fear for her life to shoot a car burglar.

There use to be an alley fence down the street from my place that said”if you come on my property I’ll kill you” painted in big letters. I bet nobody came on the property.

Our state recently got the castle doctrine, so if we are in our car, motor home, motorcycle, we can defend ourselves like we can in our home. Our state law is clear. We can only use deadly force if there is the threat of human bodily harm.

Our instructor told us we need to be so confident with our firearm, that we won't draw it too early and it cuts down on accidental shootings (finger on the trigger when drawing, etc). He also said that when the police get there say, “there is the bad guy, here is the gun, I would like an attorney.”

Texas law is a bit different. Here we can shoot in defense of our property. We can even shoot in defense of a third party’s property.

I have been told a different mantra by the cops and trainers, depending on the situation. “I was in fear for my life, I am feeling sick and want medical attention and a lawyer.”
