Attorney Philip J. Berg defends Obama birth certificate lawsuits

Editor's note: Philip J. Berg, former deputy attorney general of Pennsylvania and an activist attorney who brought a lawsuit challenging the eligibility of Barack Obama to become president of the United States, has written the following reply to Jamie Freeze's Dec. 22 RenewAmerica article "Facts are stubborn things: Obama is a natural-born citizen."

Jamie Freeze, a law student, has called any of us who question Soetoro/Obama's citizenship status and constitutional eligibility to serve as U.S. President --- a constitutional right of ours, of course --- incompetent idiots. Ms. Freeze, however, may want to continue her education. Part of being a lawyer, a very important part, is being able to comprehend what you read and to cite the correct law to collaborate it, something Ms. Freeze has clearly failed to do.

I will respond below to Ms. Freeze's allegations. My responses are in bold. I also want to make very clear to all readers that none of the eligibility cases have been heard, litigated, or dismissed based on the law pertaining to any of the issues raised. Instead, the eligibility cases have been dismissed on the basis of "STANDING" only.

The process to cover his illicit trail started before he ran for the DNC nomination and has continued since the election of ‘08. Perkins-Coie is not a cheap firm. The naysayers are simply trying to divert attention with their constant clamour for ‘proof of costs’. One wonders where these sleepers at FR get their too tight kneepads ...

This young lady is taking quite a bit of irrational abuse on this forum and likewise irrational condemnation from a group of people that under any other circumstances would more than likely embrace her and her values.

I think her name calling invited the abuse. To wit: "Here goes: If you believe that President Obama is NOT a natural-born citizen, then you are an incompetent idiot who is probably watching Glenn Beck while wearing a tin-foil hat. You probably think Obama's a Muslim too."

She found the necessary words to insult many people to make her case. Rather than investigate the veracity of Berg's claim she chose to attack him and equate Beck to him. To my knowledge Beck has never stated he believes Obama is NOT a citizen. I think he shies away from the subject and occasionally makes a reference to it but has not declared a position.

I did read the article. I found her to be, as usual for pundits these days, to be quite intensely equivocating.

I do, however, like her conclusion: "So the question isn't whether a Christian can be a Republican (or Democrat). The question is whether Christians are being Christ-like in a Christ-less society."

To me the last comment by Mr. Berg is the most troubling to explain away. If Obama was born in Hawaii and there can be no question about that produce the long form birth certificate and be done with it rather than spend over a million dollars fighting its release. I am a US citizen born in this country and proof of my citizenship is a matter of clear record. Why does Obama have such a problem simply releasing the records that would make this whole thing go away?

Legal fees are listed in the Obama presidential campaign’s FEC filings that are public. You can find it by googling the FEC reports. It shows that since the election, Team Obama has spent some $1.7M on legal fees, presumably defending various eligibility challenges.

That bothers me a lot, too. You hear this claim all the time plus the number of law firms fighting to prevent the release of the BC, but I've NEVER seen any hard evidence to back it up. It seems to have become urban legend.

I respect Mr. Berg's response, but he needs a proof reader and less dependence on spell-checking: "Part of being a lawyer, a very important part, is being able to comprehend what you read and to cite the correct law to collaborate it, something Ms. Freeze has clearly failed to do."

Clearly he meant "corroborate it." Small nit to pick in an otherwise fine response.

I agree. I read this article from a Google alert I get. I was really pissed but there was no comment section. Then I saw that a Freeper picked it up. She definitely intended to be insightful and I for one am glad to see her being taken to the shed on this one...

But when you combine her profile with the picture she paints of herself with her comments, Freeze looks very much like a liberal pretending, for strategic purposes, to be a conservative. For example, some conservatives might think Glenn Beck is a bit over the top but none would try to marginalize him in an ideological context.

At this point I’m not convinced she’s not an Obama lover.

We can certainly agree, the young (and I stress "young") lady is quite naive and that her writing skills could definitely use some further honing. And I also agree she needs to acquire a bit more humility, which should come as she grows through real life experiences, but the point of my reply to you was basically aimed at the knee-jerk, uninformed reactions by folks on this forum.

It will be interesting, only mildly, to follow how she develops once she leaves the insular existence of academia and enters the real rough and tumble world.

Good point, my argument is the constitution says “natural born citizen” which requires BOTH parents to be US citizen which in this case one is not, the father! Remember Obozo said in his book he found his BC at his grandmas house? well barry show it and be done with this nonsense!
