There is no indication in the story that the bitch was in heat at the time of the shooting. I think the reckless endangerment charge is a bit much considering that the shot was birdshot from a .410 and downward into snow. Snow is a very efficent ballist energy absorber.

The shooter seems to have made the common mistake of thinking that birdshot is not deadly at close range. At close range, bird shot is very deadly, not to mention that a small dog is about the size of a large bird.

I should have said that only the owner of the dog who was shot said the bitch was in heat at the time of the shooting.

The 10-year-old Chihuahua, Faux Pas, was apparently attracted to Mueller's own dog, which was in heat, Glasgow said. Mueller's dog was in a fenced dog run in the yard, which itself is not fenced.

On the other hand, the bitch-dog was far larger than the Chihuahua. That would be one very difficult mating.

That is possible, but I doubt it. Those are extremely rare. Even .410 doubles are rare. This smacks of a journalist trying to add a little glamor to his story.

Popping somebody’s Chihuahua with a .410?! Come on! Every Chihuahua I’ve ever met was an obnoxious wee beastie. However, I could never bring myself to so much as yell at one. The little tough guys are just too darned cute. Atomizing one with a shotgun would leave me devasted by guilt. That’s one mean old man.
