RICHMOND, Va. - A federal judge on Tuesday dismissed Liberty University's lawsuit challenging the Obama administration's new federal health care law, declaring that a provision requiring most individuals to obtain insurance is constitutional.

BTW: This is NOT the VA AG’s lawsuit on the same issue. That decision is still pending. Liberty University filed this suit separately from the one that the Attorney General filed in Richmond.

The judge in the Richmond case is a G.W. Bush Appointee.

It will be interesting to see if any of the newly-elected Tea Party Republicans will introduce a resolution to impeach the judge for his tyrannical misconception of the Constitution.

"...The conservative Christian university founded by the Rev. Jerry Falwell also claimed the law violates its religious rights by forcing it to subsidize coverage for abortions, but again the judge disagreed. Moon said the law includes provisions that allow policyholders to avoid subsidizing abortion coverage."

How can they achieve that?

This Judge is an idiot. He has basically said that Congress can require people to buy anything that affects a ‘market’. Nothing makes the health care market special in this regard and under this justification congress could require people to purchase all sorts of things that may be deemed important by congress. What next require people to buy new cars every year because it benefits the auto-industry and thus the employees and thus the nation? Judges like this and people who think like this leave me little faith in anything short resetting the whole damn system. You can’t reason or compromise with those who don’t accept any rules of the game except those they make up to fit their own desires.

Why should they? They are merely representatives, and it should be clear by now that they represent a supine people.

“It will be interesting to see if any of the newly-elected Tea Party Republicans will introduce a resolution to impeach the judge for his tyrannical misconception of the Constitution.”

If you want to kill the Tea Party Movement, that would be a great way to begin. Just move to impeach a federal judge because you don’t like a judgment he rendered.

Simple, the government just tells you it was some other person’s money that paid for that abortion.*

*Like they do with their Secure Slushfund (Social Security).

Essentially, in matters of civil law, you can judge shop. That means, you have a pretty good idea of what verdict you’re going to end up with going into the fight.

We have to accept the fact that the judiciary has degenerated into a political body. However, if the U.S. govt. ultimately prevails on this issue, we will also have to accept the fact that the Constitution has effectively been repealed.

Which will necessitate the people falling back to the Declaration of Independence.

I’ve known several lawyers and all I can say is that law school causes brain damage. Even conservative lawyers, some of whom I like, have some screws loose. I’m not joking. Something happens to them during law school and they come out half baked.

The fact that you believe a move to impeach a federal judge who often makes unconstitutional decisions from the bench is only being considered because some people don’t “like” his decisions.

Such an opinion is a clear indication of a person who doesn’t mind an ever expanding federal government that continually acts to reduce the freedom of the American people. Those are the chains I referred to.

Impeachment is by votes; it’s a question of whether the votes are there.

It’s not a matter of impeachment because “I don’t like a judgment”. It is a matter of getting a judiciary that has a conception of the Constitution that is consistent with the continued existence of the country as a Free Republic. Any judge who believes that the federal government can regulate anything that might affect commerce is unfit for the bench, because he believes there are no limitations to federal power whatsoever, which destroys the entire design of the Constitution. If you understand what the Founders were trying to achieve, you would see this as treason to their objectives.

The SCOTUS’ left and right wings have assented generally with the premise that Congress can do anything affecting markets under the commerce clause. You can’t reason with judges when they rule without any real oversight. When was the last time a justice feared impeachment? Ever?
