It's as simple as that.

Declare a budget emergency. Shut off the heat and the a/c. No more paper for the photocopiers. No more paperclips. No more parking spots.

A few years back a judge in Kansas actually decided that a school district was under funded, took it over and directed how it was to be run, RAISED taxes to pay for it, and then ultimately it failed anyway. Nothing was ever done to him or about him for so grievously over stepping his bounds. IIRC

Funny, I thought that's why they call it "insurance," a way to manage and disperse pooled risks. The judge thinks charging for insurance is illegal? WTF??

That makes no sense at all. But the judge is clearly a Democrat. I saw state "workers" picketing downtown this PM, the most poignant B.S. I saw on one of the signs was "Some Cuts Don't Heal". Some years ago (a Republican was governor then, too, WEIRD COINCIDENCE) the most revelatory picket sign I remember was "Overtime Is Not The Answer (But the Pay for Overtime IS)". Thanks Libloather.

Now riddle me this, the judge ruled because he says the legislature has the unfettered discretion to take benefits away -

But it doesn’t have the discretion to charge 3% ?!

The solution is simple to reign in judicial activism, the legislative branch just refuses to do it. All that is necessary is to escort the offending judge in front of a oversight committee, read him or her the riot act for overstepping their jurisdiction, and then defund their court and have other courts take up their cases. After a few of these examples, the judicial branch would start to clue in that they are not the ones making or funding the laws.
