Debt collectors, State and Federal Law

Much thanks to the Freeper referred SA law firm which advised and offered services which I did not accept, but paid close and attentive attention to.

Your counsel . . . pending the next elevation when I might need it . . . was invaluable to get this much of a result. Thanks.

Maybe there might be a class action or federal complaint against CMRE . . . based upon thier reply to the California Attorney General, there might be one.

I'm going to press to the federal level with a complaint.

In reply to the California Attorney General, CMRE made certain statements to the inquiring state agency, never mind Texas, which they cannot substantiate and are easily proven in court to be false.

Presently drafting a response, and thank you letter, to the Attorney General of California, the Attorney General of Texas, each copy to be forwarded to the federal responsible agency.

Will post relevant portions of my letter probably tomorrow.

I received notices some months ago from CMRE, a California debt collection business, sent to a Texas resident who they misidentified during what they told the Attorney General of California was a computer generated attempt to reach the actual debtor.

They sent me three collection letters on behalf of three health providers, only two of which were named . . . trying to collect the debt I do not owe . . . not to ascertain the address of the person who actually incurred the debt. Demand for payment was sent to me.

The response to the Attorney General of California admits I do not owe the debt, but implies the debtor may be my son or some relative who resided at my address.

CMRE’s false assertions are easily proven untrue.

I filed a complaint with the Texas Attorney General with attachments, which were forwarded to California.

I helped a local minister file a federal FDCPA lawsuit in US District Court back around 1994 against a lawfirm collecting for a hospital. When the dust was settled, they admitted under oath all his filing claims, which they had previously denied, were true, and admitted that all his claims, including one that they'd committed multiple counts of mail fraud, were also true.

Interestingly, one of the three attorneys is soon to be the next Democratic candidate for Indiana governor. So far neither of the Republican likelies have shown the slightest interest.

I’m trying to follow all governmental chains and lines of communication . . . if failure leads to a legal complaint, I hope I’ve filled in all the squares necessary to make a state/federal lawsuit viable.

Go get 'em. This may be of assistance as well. You may wish to discuss the potential of a FDCPA suit as well, and remember: if FDCPA violations are proven, the use of illegal means by the debt collector to collect the debt, whether a valid debt or not, nullifies the debt.
