Obama Administration Blocks Law Requiring Texas Residents to Show Photo ID Before Voting

The Justice Department is objecting to a new photo ID law in Texas for voters, saying the state has failed to demonstrate that the the law is not discriminatory by design against Hispanic voters.

The department's head of the civil rights division, Tom Perez, wrote a a six-page letter to Texas' director of elections saying that Texas has not "sustained its burden" under Section 5 of the Voting Rights Act to show that the new law will not have a discriminatory effect on minority voters. About 11 percent of Hispanic voters reportedly lack state-issued identification.

Perez wrote that while the state says the new photo ID requirement is to "ensure electoral integrity and deter ineligible voters from voting" the state "did not include evidence of significant in-person voter impersonation not already addressed by the state's existing laws."

Perez added that the number of people lacking any personal ID or driver's license issued by the state ranges from from 603,892 to 795,955, but of that span, 29-38 percent of them are Hispanic.

"According to the state's own data, a Hispanic registered voter is at least 46.5 percent, and potentially 120.0 percent, more likely than a non-Hispanic registered voter to lack this identification," Perez wrote.

Good question! Does anyone complain about requesting ID to purchase cigarettes, alcohol,or when buying something with a credit card?

If they get away with this NO ONE should show ID when voting. Let them guess whether two districts or voting for your neighbor or for someone who has recently died ... or whatever.

Put two Texas Rangers in each Precinct to be sure the Voter ID Law is followed.

If there ain't enough Rangers, I'm sure a whole lot of Texans would have no problem being Deputized to fill the shortage.

What will the Judge do, send in his Army? Perry controls the Texas National Guard, LOL

Agreed, its long past time the southern States start asserting their EQUAL rights under the U.S. Constitution to the application of UNIFORM laws.

If the North don’t have to submit the South should absoulty refuse submission!! If they lawless Federal Government can’t find it within itself to treat the members of this union as Equals then we should appeal to the justice of nature and the opinions of the rest of the world this injustice of Washington.

An injustice Not only against our people as States but against the very minority they hypocritically claim to be trying to protect. After all the explicit propose of theses laws is to protect the vote of each and every individual from voter fraud.

To deny any particular “Race” of men application to this law is to expose the same men to the same portability that others might pose as them and Steal their vote!

Are not Hispanics and African Americans entitled to the same protection as whites, or does the Democratic party see them as a group of targets that must be left open for fraud?

Section 5 of the “voting rights act” which spells out particular states for discriminatory laws to be applied is in blaten violation of not only the 14th ammedments EQUAL protection clause its a violation of the Federal constitutions Equal Standing clause.

I don’t know what the democrats of the 1960’s were thinking you would think that if they were going to install a repressive mandate the least they could do is apply it equally to all the State. But instead they make it clear in this lawless act that some states are “less equal” than others.

That concept in itself is absolutism repugnant to the idea of a free republican union. But I guess their idea of the “united states” post Lincoln was that of a lawless(boundless) empire not a republican union at all.

As a Texan I find this discrimination extremely insulting.

Many northern States do, Its us southern that are subjected to this lawless indignity “federal acts” applied to us and us alone. Equal footing is a myth they gave up on a very long time ago.

I am a Texan, and to Washington that makes me scientifically less entitled to self-government than you a Michigander. I suppose it don’t much matter because in either case If they don’t like what we choose they come in and impose their will. In the long run tether of us are free men nor free peoples we individuality & collectively(as States) are both slaves to Lincoln’s Empire.

This whole issue isn’t as simple as it seems on the surface. The “preclearance” requirement in the Voting Rights Act (in Section 5) has a history of litigation in Texas.

The 25-year extension of the preclearance procedure (by Pres. Bush and the Congress in 2006) was challenged in a lawsuit in 2009 in Texas, but the Supreme Court failed to declare preclearance unconstitutional.

Then how do they get housing? You have to show a picture ID to rent or buy.

How do they cash their paychecks? Banks and credit unions want a picture ID.

How can they get a car? You have to show a picture ID to rent or buy a car.

How do they get healthcare? You have to show a picture ID to get treated by a doctor.

This is just more left-wing crime.

As a Texan I find this discrimination extremely insulting.

The case is insulting. The authority is firmly grounded in the law I cited, whatever you think of its legitimacy. Certainly the ratification process of the 14th was an abomination.

Really? That sucks, but there goes the DOJ argument. Unless the poor "disenfranchised" are bums living on the streets, Hispanics (legal or not) pay utility bills.

The Texas Attorney General should send this section of their statute to Holder, and tell DC to suck it.
