Maybe Roberts Got it Right After All

Upon further review and discussion here, I've concluded that the majority opinion of Chief Justice Roberts in the ObamaCare case was exactly what this country needed. He effectively took the heap of crap that had been dumped in the halls of the U.S. Supreme Court and tossed it right back out where it belongs: in the homes and businesses of every U.S. citizen who has allowed this bunch of fools in Washington to govern us this way.

Think of it, folks ... Any obligation of the U.S. Supreme Court to deal with this idiocy went out the window the moment that dingbat Nancy Pelosi stood up on television and said: "We have to pass the bill to see what's in it."

If I were a Supreme Court justice, I wouldn't spend 30 seconds of my life reading a single legal brief in a case involving a Federal statute that was passed even though the Speaker of the House of Representatives didn't even read the damn thing before voting on it.

On top of all that, just consider this: There were 28 states that filed legal challenges to ObamaCare, either individually or jointly. How can 28 states file legal challenges to a Federal law that was passed in the U.S. Senate by a 60-39 margin? If I'm sitting on the Supreme Court and the Attorney General of, say, Pennsylvania (which is one of these 28 states) comes in for oral arguments in the case, my first and only "question" would be: "If you have such a problem with this Federal statute, why don't you take it up with Bob Casey, Arlen Specter and those nine House members in your state who passed the damn thing ... along with the idiots in your state who cast their electoral votes for that jug-eared Kenyan nitwit in 2008?"

It is never, ever going to be repealed. Ever. Not only may we not take the Senate back in Nov, there is ZERO chance we’d get 60 votes to repeal it. Also, you KNOW Romney would change radically if he ever got in office.

I’m with you - if Americans want a Constitutional government it makes MUCH MORE SENSE to elect people that feel that way, rather than relying on a couple of people (Roberts and Kennedy) who probably have been promised that their grandchildren never make it to adulthood, unless they vote ‘right’.

And the court is there to PROTECT the American people form the unlawful actions of the executive and the legislature. THIUS court and THIS decision do nether. Between this and the Arizona decision Hugo Obama has gotten himself some powerful new weapons.

Elections will not reverse this precedent. Nor will any president have enough nominations in one term to undo this. We are stuck with this the same way we are stuck with social security

But it’s coming into my home and I didn’t vote for Obama! If Roberts is trying to teach us a lesson then he picked a odd way to do it. Why should all of us suffer for the idiots who voted Obama in. And if he is trying to teach Obama a lesson he could have just voted like a conservative. He’s either a genius or a traitor - I haven’t decided yet. All of this makes my head hurt!

I am in eastern Kentucky where talk radio is hard to tune in. I had to listen to NPR flunkies spike the football and bait conservatives today.

The court’s job is to reject assaults on the constitution such as this. None of the people voted for this mess. None of the Democrats in congress voted in the interest of their constituency; they voted for the unlawful favors that they got for voting against the people deliberately.

That’s exactly how it needs to be struck down. I suspect thigns are going to change dramatically even if Obama wins in November — as U.S. businesses begin eliminating insurance coverage for their employees and letting those employees fend for themselves under the weight of ObamaCare.

I agree with you.

the government’s attorneys were not clear about whether what they were arguing was a “tax” of a “penalty” having sold it as one thing and packaged as another.

You don’t come before the Chief Justice unsure of what you’re talking about. All Justice Roberts did was define the “whatever” as a TAX.

There are 23 Democrat Senators and the Prezzy that now have to stand for re-election having authored and passed the largest tax increase in all of world history. With gasoline at 4.00/gal....and unemployment at 8.5%.

Would’nt want to be them.

If the Pubbies don’t manage to snatch defeat from victory THEY CAN BE LOOKING AT A 70 SEAT SENATE.

Not a bad analysis, more interestingly to me is how a fee or penalty has been morphed into a tax.

By definition it could be argued that all income to the government from it’s citizens should now be classified a tax. No more fee’s no more penalties or assessments. It has profound implications.

When has a major federal program, once funded, ever been reversed?

This morning there was a chance it would be. But tonight you can turn out the lights.

Maybe if elected Romney will strike it down, but he'll certainly replace it. With what we don't know. And thats now the best case.

I too have ruminated on this thing and agree with you.

In a screwy, convoluted way, Roberts may have thrown it back to the ANIMALS in Congress to fix it!

Not defending Roberts here but now we have to get sensible control of the House and Senate.

Not really. Roberts sends it home to the House declaring it a tax......just prior to the 2012 elections.
