Did Holder Initiate the Legal Process For Boston Bomber To Shut-up And Lawyer-Up?

FBI was shocked when a Judge came into the hospital room to Mirandize the Boston bomber. Megyn Kelly does an impressive job explaining the chain of events and the implications. [...] Dzhokhar Tsarnaev was caught alive but wounded on Friday and charged with use of a weapon of mass destruction, for which he could get the death penalty. The FBI filed a federal criminal complaint against the 19-year-old on Sunday, and federal District Court Judge Marianne Bowler arrived at the hospital where he is being treated to preside over his initial hearing Monday, when she read him his Miranda rights.

Judge Napalitano on FOX News explained how it works. The timing, etc. for a US citizen. He seemed to be OK with it, and I don't get the feeling he's an Obama fan.

The part about the judge going to the hospital room had me, but the Napalitano said that does happen so that the presiding judge will know the suspect was read his rights.

I still don't like it myself. The little creep should be treated as an enemy combatant, and I do feel that this order to Mirandize him came from high up, probably Holder. The wheels of justice turn slow. Maybe more information can be dragged out of the perp that will lead to other terrorist cells, but I think that info died with his brother, who seemed to be more the mastermind behind all this.

Time will tell.

there is not one of us who a judge would come and visit us in the hospital to read us our rights.....we’d be in jail immediately...

No. Not if they want to remain on the public's payroll.

And, getting a job in the private sector is . . . . . . well . . . . . . . too much like work!

Naturalization can only be revoked in a judicial proceeding, or through an administrative proceeding subject to judicial review. In short, Tsarnaev is an American citizen whether we like it or not (I don't), and is therefore entitled to every right of an American citizen until he is convicted in a court of law.

As for the overwhelming evidence against Tsarnaev, we have a Constitutional process for presenting that evidence at trial. It works for all of us or it doesn't work at all.

We should guard against selective protection of citizens' rights, and we must ensure that they apply to the worst and most hated criminal defendants. Who's to say that Christians won't be the most despised people in America in a few more years?

Possible...criminals seem to have their own court of justice regarless of what they’re charged with in the legal courts. They do seem to get those who have k*lle* many though.

Tsarnaev is an American citizen arrested and charged with committing a crime on American soil. For a similar act, Timothy McVeigh was tried, convicted and executed without his Constitutional rights being ignored. Tsarnaev deserves the same treatment, and if convicted, the same punishment.

Let's fast forward to a time in which your beliefs and way of life place you outside the law, even in Florida... Will you then possess the rights of an American citizen, or might a bureaucrat popularly label you as an "enemy combatant?"

I am astonished anyone is still gnawing on this bone. With an abundance of physical evidence to convict, statements by the perp will be unnecessary to try him. If his statements are not to be used as evidence, the "Miranda" warning is irrelevant.

On the other hand, continued interrogation could have yielded more useful information about others involved, including connections to people in or close to the regime--which is why the judge was sent in to shut him up by reminding him to "remain silent."

Sorry. I can't see myself as doing anything like blowing up innocent people. That's what makes me want Tsarnaev to be treated as an 'enemy combatant'. The more people that understand we are at war with radical Islam (or, more precisely, radical Islam is at war with us), the better the chances of us winning.

If the Tsarnaev's had blown up an empty office building or similar place, without loss of life, I could go easier on him.

advocate.they were noted by our own intelligence via the Russians!
more than enough evidence for militant enemy combatant status.

This is obama’s cover for terrorism. All this does is tie-up the courts. we have laws that deal with domestic terrorism
but Zer0 and Holder trumped them.

this does nothing to embolden civil rights but plays into the manipulation of our justice system which favors enemy combatants.

I thought he was still on a visa of some sort.

That would be the late Speed Bump Tsarnaev. The "citizen" is his little brother Joker Tsarnaev, in custody and hopefully at the beginning of a long journey to Terre Haute.

After listening to Mark Levin explain this several times, I still doubt I could accurately repeat the finer points of it all.

What I do believe to understand is that yes, there is no doubt his actions fall under terrorism and thus he would be afforded no miranda rights, however, with the help of leiberman and graham, they passed a resolution to give due process rights to terrorists...in line with the whole unintended consequences theme.

It was passed in 2001 and stated that an enemy combatant had to have a connection to al quaeda or be an operative of al quaeda...however you spell that dang word!

Just go to his web page and anyone can listen for free to his shows this week, he covers it several times.

Miranda is not important to convicting this scum bag. There is ample evidence to do this before he was apprehended. He is toast. Anything he said without being Mriandized would not be admissible in court. Everything he “would have said” is absolutely crucial to taking down other possible bad guys he may have been working with.

What is important is that the moment he was Mirandized is he quit talking. What is important is our justice department sent in a Federal Judge to Mirandize him knowing he would then stop talking. WHY DID THEY DO THIS???????????

In my mind “enemy combatant” applies to these guys. It fits his feelings and his actions and the dynamics would have been different if non-citizen big brother had been captured alive. They were not natural born and they murdered and maimed innocent Americans because they don’t like what our government is doing overseas. They obviously had hatred for this country and it’s people. The younger one gaining his legal standing on Sept. 11th seemed to have been a ruse if you ask me.

And, he hasn’t shut up since being read his rights. Additionally, he and his idiot brother confessed to a third party who can testify, the carjacking victim. Most defense lawyers would try to exclude anything said prior to him being read his rights. He’s going away forever, if not being put to death.
