Do Executive Orders Violate the Constitution?

The Myths

Presidents can issue executive orders that are legally binding on the general public.

These executive orders are backed by the full force of law just like laws passed through the formal legislative process.

A president can use executive orders to go around congress.

The president can use executive orders to modify laws passed by congress and can order executive departments to selectively enforce provisions of laws.

These executive orders are authorized by the Constitution.

The Truth

Yes the president can issue executive orders however these orders are only binding on members of the executive department of the federal government. They are not legally binding on anyone outside the executive department.

Only laws passed through the formal legislative process have full force of law. Executive orders do not meet this requirement.

Congress alone has the power to write and pass laws. If congress chooses not to pass laws that the president advocates for the president can in no way act unilaterally. The president is restrained by the Constitution.

The president must enforce laws that are passed by the formal legislative process as they are written. If the president does not like a bill passed by congress or feels it violates the Constitution then the president can veto it before it becomes law.

Issuing executives orders that are given the full force of law is a clear violation of several provisions of the Constitution.

BUT NOTE! The reg does mention the AG being authorized to make changes to the list, but that would be by separate rulemaking. Now THAT would bear some watching

Of course. If one wants water at point B from point A....one must first build the infrastructure before opening the flood gates.

I get the sense that this is what is being done with this regulation. But then, I trust no one.

When did Congress ratify this treaty? Or do they just not care as long as they get their pay and perks? The French got one thing right with that revolution of theirs. they removed a lot of over head.

It was Bush 41 that stuck us with the Arms Export Control Act. It was that act that made it virtually impossible for us to re-import WW II lend lease small arms and it’s been screwed up ever since. Throw that in with the import limitations of the 1968 GCA and Obamuzzie has all the authority he needs to ban export/import of most anything small arms related. Those are the basic reasons that numerous Euro arms makers have opened mills here——so they can get access to our market. So far they were able to make most of the parts in their old Euro plants then just finish them here. This new Obammuzzie deal looks like it can stop even the small parts imports.

I guess you can say that if trade is totally stopped then it has indeed been “streamlined”——no delays, no lines, no waiting——no nothing!

You’re right except it wasn’t executive order——it was the Arms Import/Export Control Act (sp). Bush 41 started the big double cross with respect to firearms. I believed at the time that he had no freeekin idea what he was signing.

But they won't try to enforce it across the board. They'll do it selectively. They'll nail some poor schmuck who's working class or worse, a middle class working professional like a teacher or middle management somewhere who can't really afford top of the line legal talent. Then they'll crucify the poor slob so badly and so completely that everybody else who could have filled those shoes (but didn't) will start wondering when they're next on the block.

Busting down a door in the middle of the night amid a huge sweep to grab guns is one thing. Maybe you go out in a righteous firefight, but you know your neighbors and buddies (wherever they are) will be going thru the same thing and maybe you'll all meet up in Heaven and hoist a cold beer to each other's patriotism. But being faced with the prospect of going it alone and being prosecuted alone is going to be somewhat more... daunting.

Just ask the poor guys in the military, the officer (I think he was a doctor) and the enlisted man (SP/4 Michael New?) who refused to follow orders to deploy under U.N. command and got a court martial for their trouble and oh yeah, jail terms. The enlisted guy went to jail for sure. Not sure about the Doc, but he lost his career and any chance to continue that outside the military, so that's pretty awful. A lot of folks were "pulling for them" and raising cash for appeals etc, but those folks were still going home to the family (and off to work the next day) while the two making the valiant gestures are still either in prison or having a ruined life. Alone with the reality that the world didn't stop and the NWO marched right along and over top of their bodies. I keep watching that series "Beyond Scared Straight" and thinking about that reality. Such an E.O. doesn't have to be universal in it's application to still be frighteningly effective.

They are in a club of political elites, and most of us are not it it. Congress rarely stands up for our rights. They are too busy with their palm out looking for handouts from lobbyists to get reelected. The elites want the serfs disarmed, and that is the way it has been in all recorded history. Both Parties talk about freedom and liberty while neither gives a hoot.

My guess would be that it contains unicode that is clashing with HTML.

That shouldn't happen. HTML uses ASCII characters to indicate mark-up, Unicode is a superset of ASCII, therefore any unicode document should be parsable as HTML.
(Granted you can do screwy things like reversing byte-order, but that should turn the whole document into gibberish, if anything.)

Every single day you can’t carry from coast to coast, it’s being infringed.

Every time they tell you that you can’t own whatever they deem scary, it’s being infringed.

Every time you go to buy ammo and can’t, it’s being infringed.

Every time you go to buy a firearm, and you’re told there’s a “Cooling Off Period” or waiting period of some kind, or you’re asked to show a FOID, it’s being infringed.

What do you want to DO about it is the question...

I don't live in a cave and neither do millions of freedom loving Americans across our nation.
Actions the IRS are taking are also infringing on our rights to Vote and Upholding the constitution
through freedom to petition our Government, by organizing traditional protests against ALL.

I certainly hope our Government is coming to a headway in their unconstitutional actions
and the tide turns. Many are doing something about it, and I can only help fund
those who are because I do have a company to run. We all pitch in however we can.
