Regime to Justice Roberts: Catastrophe If You Rule Against Obamacare

RUSH: Here's how the Regime's doing it. The Regime and the Drive-Bys are trying to intimidate the court, trying to influence the court, trying to shape the court. Josh Earnest, press briefing at the White House today. A reporter said, "One of the justices this morning suggested the court could give states time to prepare for the impact if it decided to rule against the government in this case. I'm just wondering if you have any response to that, Josh. Would that be feasible? Just wait 'til next year for a decision like that to take effect?"

EARNEST: It's important for people to understand that there is no contingency plan that could be implemented that could prevent the catastrophic damage that would be done by essentially undermining the Affordable Care Act with an adversarial, uh, ruling on this. The truth is that there are no easy answers! There is no simple step, no obvious step that anybody can take that would prevent this catastrophic damage from taking place.

RUSH: Okay, and what that's supposed to here is Justice Kennedy and Justice Roberts are supposed to go home tonight and turn on the news, and they're supposed to see the White House press secretary say that if they rule against the administration, "It's gonna be a nationwide catastrophe! You don't want that on your shoulders, Judge, and you don't want that on your shoulders, Mr. Chief Justice. It's gonna be a catastrophe! We don't have any contingency plan. You're gonna be wiping people's health care out."

That's how it's to be reported, and it is not just Earnest doing it. This is happening throughout the Drive-By Media. The reason is, they think it worked on Roberts the first time. They are convinced that it worked on Roberts the first time. Note, by the way, it worked on Roberts, not Kennedy, the first time. Everybody thinks Kennedy is the swing vote that we need to be worried about, and I'm thinking you may need to change your focus on that, folks, just a little bit.

Yes, but in this case it is not a Constitutional question, it is merely a matter of statutory interpretation. Laws ought to be read and applied as written, not interpolated and reinterpreted to achieve a politically desired result. This quite apart from issues of Constitutionality.

Didn’t hear one person talk about the fact that in all those videos of Gruber, he clearly stated that the law was written in a way that should force the States to set up exchanges.

Those very Gruber videos were run (and discussed) on at least two Fox News shows earlier today... on Special Report with Bret Baier, and on The Kelly File with Megyn Kelly.

I analyze laws for a living. Absent ambiguity, there are very few instances when “legislative intent” is presumed to trump the actual letter of the law.

Not only is that a correct rule as a generalization, but the Supreme Court has historically not only refused to rewrite legislation on this basis, the Court has specifically refused to consider legislative intent to interpret legislation.

MORE IMPORTANT! Everyone should write the House and Senate Judiciary committees asking for immediate action on the following issue. If you have a Senator or Member on Judiciary, write them a direct letter. The threat that Justice Roberts is subject to personal pressure merits review and consideration by Congress.

Three years ago, Supreme Court Chief Justice John Roberts cast the tie-breaking vote in a ruling that saved President Barack Obama’s signature healthcare reform.

As everyone is aware, there is extensive gossip in the political community to the effect that Roberts and his wife have only two children who were adopted.

They were purportedly born in a foreign jurisdiction and there were in place legal constraints that effectively precluded US persons from adopting children born there under the circumstances of the Roberts adoption.

So to avoid those restrictions, the adoption was accomplished through the device of a third country system. Whether or not the third country worked to accomplish an effective adoption or not is not clear from the level of gossip in circulation.

The presumed threat is that the Roberts’ could lose their two children several years down the road from the initial adoption events.

The end consequence of this condition, as reported by loose talk and political gossip, is that Roberts’ vote on Obamacare was leveraged by the zero in the White House to uphold legislation that everyone knows is unconstitutional on its face.

I do not know what, if any, merit, substance, or facts exist to support the gossip.

I think it is and was the obligation of the Senate Judiciary Committee to know stuff like this. The gossip alone, unrefuted that it is by any authoritative response, affects confidence in our Constitutional process.

What should be done is that House Judiciary should immediately schedule a hearing on the issue and subpoena Justice Roberts to explain the actual facts.

Interesting to me that the administration feels that following the Constitution is a “adversarial” position. Very revealing.

Earnest called a potential decision against the government "adversarial". The Judicial Branch disagreeing with the Executive Branch is "adversarial"? Sorry, Barack, no, the Supreme Court's decision will be final and binding, on you. Your adversaries are the majority of States of the Union.

Yes, revealing. Obama has shown that he looks at the Constitution as an inconvenient obstruction to his national makeover.

The SC must rule according to LAW, not according to perceived disaster prevention. If a disaster is created, the problem lies with the bastards who created it, not the Supreme Court.

It was explained last night on Mark Levin.

And if I may paraphrase the discussion for those that didn't hear, if the Alchemist in Black Robes divine that the Federal Xchg stays, we have essentially eliminated Congress and "Statue" and have created some new Executive branch Beast and that in theory ALL laws and reg's that Congress enacted are on the table for tweaking via Lear Deader's Fiat...

Serious as a flippin' heart attack, this ruling is that tipping point...

Agree... The catastrophe has already occurred. Saw it first hand a year ago as you described. Roberts needs to be an adult and make a ruling that forces Obama to work with the Republicans and create a bi-partisan solution that will not further bankrupt the country. If the economy gives down the tubes now affordable health care will be unattainable. And, this is not Bush’s fault.

As if the Obamacare act in the first place wasn’t a catastrophe,this is all a bunch of crap,the country has been finished for a long time.
The first time around Roberts said something to the effect of ,the court can’t be responsible for bad policy made by the people’s representatives,that’s not their job.So now What?
I think Roberts has been blackmailed anyway

Rush knows dam well that Robers was blackmailed by the regime the first time around because he smuggled his kids into the US from central America. I have well documented this story a dozen times or more.

Little has changed.

No one will cover the story so its still viable. The regime will keep on blackmailing Roberts until they can't.

Roberts will never go against anything they want as long as his kids are at risk.
