I’m not sure why you (and several other posters) are referring to this as “gambling”. Gambling implies that there is a possibility of losing something of value. This contest was free to enter. It was a contest, but I don’t see how it was gambling. Now, if entrants had to pay to enter the contest, that’s a different story.

Most states have laws preventing gambling by minors, which include sweepstakes, lotteries, and games of chance.

A quick search yielded this one form Minnesota

349.181 RESTRICTIONS ON WHO MAY PARTICIPATE IN LAWFUL GAMBLING.
Subdivision 1.Minimum age.

(a) A person under age 18 may not participate:

(1) as a player in games of pull-tabs, tipboards, paddlewheel, or raffles;

(2) as a player in a bingo game other than:

(i) a bingo game exempt or excluded from licensing; or

(ii) a bingo game conducted by an organization as part of an annual community event if the person under age 18 is accompanied by a parent or guardian; and

(3) in the conduct of pull-tabs, tipboards, paddlewheels, bingo, or raffles, except that a person under age 18 may sell raffle tickets.

Violation of this paragraph is a misdemeanor.

(b) A licensed organization or employee may not allow a person under age 18 to participate in lawful gambling in violation of paragraph (a). Violation of this paragraph is a misdemeanor.

(c) In a prosecution under paragraph (b), it is a defense for the defendant to prove by a preponderance of the evidence that the defendant reasonably and in good faith relied upon representations of proof of age authorized in section 340A.503, subdivision 6, paragraph (a).

Remember this ended with a drawing. Some states, for purposes of minors gambling, consider even raffles gambling. Really with 20 grand on the line and ESPN on the hook most states will find a way to consider it gambling, just for the chance to confiscate the money and look tough.

How did he cheat to win a random drawing?

I get that he’s too young to win and rules are rules. But his bracket was legit, wasn’t it? I see nothing to indicate that the boy cheated.

I can’t believe that adults of both sexes are whining and equating “lack of age” with cheating.

I didn't say "cheating", I said "ineligible". Those rules are there because it's generally illegal to award contest prizes to minors - most often, if a minor is allowed to enter, it has to be with a) a parent or guardian's permission, and b) the award is made to the parent or guardian, not the minor.

The drawing was held to choose among the best winners, it sounds like.

They normally have some kind of clause saying decision of judges is final in case of some dispute.

If I were a judge I’d say repeat whatever step involved the kid, except without the kid. Draw again without the kid’s entry in the hopper. If you want to reward the kid with a non monetary gift fine, but even that seems to wink at cheating, we mean it when we say you have to be 18 or older, that is for everybody’s benefit.

ESPN should not pay the prize because the registrant was fraudulent.

If ESPN was smart, they would do something else to deflect the apparent hype - put 20k in a 529 plan for eductional purposes or something like that.

Federal law prohibits companies from retaining personal information by anyone under the age of 13.

You are not allowed to ask for the email address of a 12 year old.

So companies with enough money (love the blatant appeal to class envy) should break the law and let the kid “win” a contest he is ineligible to even enter because your “feelings” are hurt?

You actually support children breaking rules which are in place to keep them from giving out their names and addresses online to predators?

I remember one episode had a girl who mistakenly though it was past midnight and she had just turned 18 win a slot jackpot. They got around the law by paying her the amount she won to star in a commercial for the casino.

Those rules exist primarily for ESPN’s protection, that way nobody can decide they’re letting minors gamble. Cash payout prizes and minors don’t mix.

It's not gambling, if the contest was free to enter. Gambling means you bet some of your own money to maybe win more.

If I understand the details correctly, the boy used his fathers email to submit his entry.

He should have kept his mouth shut and let his father put the claim in for the winnings.
