Really? And how do you think getting that particular "bright-line" erased would start?

Go ahead and break out your magic wand that will convince 2/3 of the Senate and the House of Representatives to amend that clause and 3/4 of the state legislaturss to approve it.

Being natural born citizen has nothing to do with where one was born.

Is there a commonly accepted definition of the phrase to support this?

I know McCain was considered NBC even though he was not born in the United States. How was that arbitrated?

That's okay. If they are predicated on the same thing as Jay and Story it'll be easy to change.

> She’s not going to let anyone tell her the top job is beyond her reach just because she was born in China.

Yeah? FOAD.

Do you have a good reason?

Yes, I do. The Founding Fathers, the Supreme Court, and historians have spoken and written at length about the inherent dangers of dual nationality. When a U.S. citzen with dual citizenship is abroad in his or her country of birth, he or she has legal obligations to that country and that country has a predominant claim to him or her.

So, while China may not recognize the Chinese citizenship of a child adopted by Americans, other countries do. The inherent dangers of having an American POTUS who has duties and obligations to a foreign country as its citizen while within its borders is obvious.

That this child feels American or is raised as an American is irrelevant. The NBC claused was enacted to prevent foreign designs on the presidency. There should be no exceptions made for Chinese-born children adopted by Americans.

She has a decent argument.

No, she doesn't. See my post below.

It wasn't arbitrated.

The following statement was published by Fight The Smears, Obama’s official web site:

“When Barack Obama Jr. was born on Aug. 4,1961, in Honolulu, Kenya was a British colony, still part of the United Kingdom’s dwindling empire. As a Kenyan native, Barack Obama Sr. was a British subject whose citizenship status was governed by The British Nationality Act of 1948. That same act governed the status of Obama Sr.’s children...”

Factcheck.org confirmed:

“In other words, at the time of his birth, Barack Obama Jr. was both a U.S. citizen (by virtue of being born in Hawaii) and a citizen of the United Kingdom and Colonies (or the UKC) by virtue of being born to a father who was a citizen of the UKC... Obama’s British citizenship was short-lived.”

How could the citizenship of a natural born citizen of the United States by governed by the United Kingdom? Obama is not eligible. He shall not be President. We have been sacked! Wake up Americans! Obama is not President. He is a usurper.

It seems you are late to the NBC discussion around here. I will save you some time regarding McCain and other statutory citizens at birth.

According to the Foreign Affairs manual published by the U.S. Department of State, statutory citizenship (i.e. granted by U.S. statute at birth) may or may not be equivalent to natural-born citizenship under the U.S. Constitution.

7 FAM 1131.6-2 Eligibility for Presidency
(TL:CON-68; 04-01-1998)

a. It has never been determined definitively by a court whether a person who acquired U.S. citizenship by birth abroad to U.S. citizens is a natural born citizen within the meaning of Article II of the Constitution and, therefore, eligible for the Presidency.

(...)

d. (snip) In any event, the fact that someone is a natural born citizen pursuant to a statute does not necessarily imply that he or she is such a citizen for Constitutional purposes.

Let little Alena go back to China and run for president there.

Oh, no free elections in China? Well then, tough panda bears, Alena. A Kenyan as president was more than enough.

Yes, I do. The Founding Fathers, the Supreme Court, and historians have spoken and written at length about the inherent dangers of dual nationality.

Such as? Bear in mind these children DO NOT have dual nationality. As soon as they touch American soil, provided both parents went to China to get them, American citizenship is automatic.

So, while China may not recognize the Chinese citizenship of a child adopted by Americans, other countries do. The inherent dangers of having an American POTUS who has duties and obligations to a foreign country as its citizen while within its borders is obvious.

Not obvious at all, particularly where there is no dual-citizenship. Please elaborate.

That this child feels American or is raised as an American is irrelevant.

Absurd! The defining characteristic to being an American, as opposed to any other nationality, is a set of ideals, not a particular lineage or race. This was eloquently elaborated on by D'Sousa, though in which of his books escapes me at the moment.

Further, it is absurd to think the NBC restriction are an efficacious safeguard against "foreign designs on the Presidency." If there is any clause of the Constitution, aside from those regarding slavery, that has been made obsolete by modernity, the NBC clause is surely it. Countries with nascent plans to subvert the Presidency simply do not work that way any more.

From here, the discussion typically progresses to Ted Cruz. So before you ask, yes, I believe Cruz is eligible. However, the courts have not ruled on it. See here for my logic on Cruz: http://www.freerepublic.com/focus/bloggers/3289769/posts?page=102#102

What part of "American" aren't you getting?

She came to this country at 10 MONTHS of age, and her parents are just as American as you.

I don’t know whether to laugh or cry at your responses. It is late. So I cannot provide an extensive response tonight. I will be happy to answer your questions tomorrow. If I forget, which is not unlikely as I am riddled with ADHD, and you want to continue the discussion, please do ping or freepmail me.

She’s 10. She doesn’t have enough maturity, life experience, understanding of history to have an opinion on this.

Children don’t have the judgement to make decisions on major political issues.

...

She’d still do better than Bathhouse Barry if she took office tomorrow.
