Plan to Bar Foreign Muslims by Donald Trump Might Survive a Lawsuit
NY Times ^ | 12/9/2015 | NY Times

WASHINGTON - When Donald J. Trump called on Monday for "a total and complete shutdown of Muslims entering the United States," many legal scholars were aghast and said that such a ban would certainly be struck down by courts as blatantly unconstitutional.

Dishonest NY Times now admitting that Trump's policy would likely be held up in court. And shockingly, they mentioned 8 USC 1182 which gives the President the right to pretty much restrict anybody that they want. Trump will be proven right again, and the GOP drifts further into irrelevance with their knee jerk condemnation of him and reactionary worry about being called intolerant. Have a great day. Make America Great Again!!

Do you need any more proof that Ryan has never read the US Constitution? How much worse are the republicans, like Bruce Poliquin, who voted for him as speaker?

Only an idiot would vote to reelect those who criticize Donald J Trump based upon the Constitution of the United States of America for their criticism of Donald proves that they have never read through it, not even once once.

For the word Religion is used but once in the US Constitution:

Amendment I.
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.
And the word Religious but once in:
Article VI.
3 The Senators and Representatives before mentioned, and the members of the several State Legislatures, and all executive and judicial officers, both of the United States and of the several States, shall be bound by oath or affirmation, to support this Constitution; but no religious test shall ever be required as a qualification to any office or public trust under the United States.

Once again Donald John Trump has played Rope a Dope and many of the dopes he roped are those who swear to uphold that which they have never read, The Constitution of these United States. For there is absolutely no prohibition on limiting or even barring immigration based upon religion.

Additionally, the US Constitution only protects those who are citizens of the United States of America. None others.

The elites think they can hoodwink ordinary people into believing that the Constitution covers everyone in the world.

I’ve pretty decided that most Republicans in the House and Senate can now say that they’ve never read the Constitution. I think at the start of every session....they ought to be forced to sit there for two hours as someone reads it to them.

If the Federal Government knew what the hell it was doing, Trump would not have to demand a pause in Muslim immigration.

96% of African Americans agree with Trump on this! WOW. What is Mayor Nutter going to say to that? And what’s he going to say when Trump visits with African American pastors and congregations in Philly! Holy, holy.

I was simply amazed yesterday listening to the MSM-Dopes on Fox and elsewhere who did not know this very basic fact about our Constitution. It protects you, me and any American citizen. It does not apply to anyone else.

Just this morning I heard Rubio say that what Trump is purposing constitutes a religious test and therefore is unconstitutional.

Add Rubio to the growing list of people I’ll never vote for.

I’ve had another thought. Why isn’t it treason to refuse to fight an enemy that has attacked the US, in the homeland, many times?

Wow, looking at your post I see that only 4% of African Americans think that Trump has gone too far. Blacks in America have seen, more than others in this country, the deleterious effects of the Muslim presence in America.

Meanwhile, back at the ranch, 31% of the whites think he has gone too far—dumb-asses. The only Muslims these idiots have encountered no doubt had smiling faces.

[Why isn’t it treason to...]

You can preface every one of BO’s actions the past 7 years with this question....

And yet still nothing has been done to address it.

It isn’t unconstitutional because the Constitution doesn’t give the federal government purview over immigration. It gives it control over naturalization, but not immigration.

Immigration is controlled by laws from Congress and by Executive prerogative over quotas and such through the State Department (deciding on who gets naturalize), but all of that can be undone by Congress and repeal of whatever laws control it. It isn’t a specifically ‘Constitutional’ thing actually delineated in the language..

This isn’t to say that a challenge that makes it to the Supreme Court wouldn’t be misapplied and held unconstitutional by it. It is riddled with liberals and quislings who want to turn the Constitution into a roll of toilet paper.

There are FReepers who believe it is unconstitutional to have a religious test for immigrants. I'm really shocked. Number one, it's law, and 2, they aren't citizens.

I’m not surprised, Pelosi had no shame in announcing that no one needed to read the CommieCare bill to pass it, and Ryan’s just part of the Uniparty.
