REPORT: Ted Cruz Entered US Illegally in 1974
The Gateway Pundit ^ | 2/12/16 | Jim Hoft

Posted on 02/13/2016 9:12:01 AM PST by Dana1960

Lawrence Sellin, Ph.D. a retired colonel with 29 years of experience in the US Army Reserve, argues that Senator Ted Cruz entered the United States illegally as a child in 1974. His parents failed to file a CRBA form which is required by US law. Ted’s parents did not fill out the required form until 1986.

Well, it means it is unfortunate his mother did not get Ted a CRBA upon birth, which made him a full on Canadian citizen until 1986 when his mother applied for a CRBA for Ted since he needed to be a U.S. citizen to get a U.S. passport to take a high school trip abroad. The good thing is he has a CRBA since age 16, and it can be applied for at any age I have read, so he IS a U.S. citizen so his senate seat is not in danger. However, this does point out the fact he WAS a Canadian citizen until 1986, when he became a dual national, and until he recently renounced his Canadian citizenship. This absolutely underlines the fact when he came in to the U.S. around age 4, it was without a passport, and as a Canadian citizen. If, as some are suggesting, the mother had taken Canadian citizenship and renounced her American citizenship, then at that point were they both illegal aliens?????? Ted Cruz, do us all a favor before we commit to you...get this settled.

That's what I've been saying since the beginning. That's where he belongs. He's a legal beagle.

But now, I'm even wondering about that.

There must be a CBRA of some sort, assuming he traveled to England in high school on a US (rather than Canadian) passport

Weren’t you insisting last night on another of these bitter `Did to!/Did not!’ threads that Phyllis Schlafly has not endorsed Donald Trump?

She registered his birth with the U.S. consulate, Frazier said, and the future senator
received a U.S. passport in 1986...

Did she only register his birth in 1986? That does mean that he was not on paper an American until he was 16.

He is hiding his CRBA and his passport for a reason.

I agree.

Release the CRBA!

We know Cruz was a citizen of Canada, because the Canadian recognition of his renunciation depends on him having been a Canadian.

Until a few minutes ago, I assumed he was a US citizen. But now I realize that he has to prove a 5 year period of continuous US residence between the ages of 14 and 28, in order to still be a citizen of the US. We don't know enough to decide the case. What age was he when he returned from his UK trip? Did he make other trips abroad? There is anecdotal evidnece that he visited Canada during college. Each trip abroad strats the "5 years of continuous presence" clock anew.

Exactly my point. Ted is a naturalised, not natural born, citizen.

Though technically, Vattel is irrelevant to the discussion about an NBC eligible for the presidency, since Vattel himself deferred to positive law when a nation put such into place.

There is no such thing as a “second birth certificate.” A CRBA is evidence of citizenship, not of birth.

Practically speaking it is both. For instance, signing a child up for school with a CRBA isn’t prove citizenship to the school. They don’t care about that. It’s proving identity like a birth certificate does.

I like Ted, I do. I think we need both men. I just don’t think he’s got the executive experience. And I also wonder; let’s say Ted gets the nod. Does Texas have anyone warming up in the bullpen to replace him in the senate? Will he be a firebrand, or a go along, get along.. Same old same old. Will he be able to get elected. If not we’ve lost a good seat in the senate.

We need a fighter in the senate too. Lord knows McConnel won’t.

-- As far as the USG is concerned the CRBA issued by the State Department IS the birth certificate. --

Negative.

7 FAM 1441.1 (State Department Manual)

f. The Form FS-240 is not a birth certificate, such as is issued by a government- authorized bureau or office of vital statistics, because consular officers are not authorized to assume a foreign local or state vital statistics function. The Form FS-240 is a consular declaration of the fact of acquisition of U.S. citizenship at birth ...

If his mom didn’t get his documentation until he was 16, I think this is a bad optics situation. I too cringe at a President who wasn’t officially American until age 16, even if he thought he was.

Until today, I didn’t know his mom didn’t register him immediately as an American. I had a son abroad and that was my top priority.

Well once he got that CRBA in l986, he was an American citizen and also a Dual National of Canada. I had read that you can apply for the CRBA at any time, not just at birth. So he is a U.S. citizen, can remain a Senator, he doesn’t need to go on a deportation list. Within the past few years he renounced his Canadian citizenship. But now it seems clear to me when he entered the U.S. with his mother when he was around 4, he was a 100% Canadian citizen, due to the mother’s lapse in not going to the U.S. Consulate prior to that time, so I now feel he better get a Court to rule on this, and soon, or he is not eligible for Prez or V.P.

She registered his birth with the U.S. consulate,

********

That isn’t clear. It can be taken two ways. It can be taken that she registered his birth
in Canada and thus he was able to get a US Passport in 1986. Or it could mean she didn’t
register until he was in high school and needed the passport to go to England.

So who knows as it isn’t clear. imo.

It seems to be something that Obama has brought to America this idea that I can make a definition stand on its head because it suits me better that way and you have to prove that I’m not right. We now live in a banana republic where the laws are only as good as the elites want them to be.

Very well said, very well indeed.

Unfortunately we have been heading in that direction for years, but Obama did indeed put the "icing on the cake" so to speak.

Find out if he ever used his Canadian passport prior to giving up his Canadian citizenship and you’d have a good indication that he’s not being honest about citizenship and a good many other things.

-- Immigration legislation does not alter the constitutional "natural born citizen" requirement for President. --

Tell that to the Federal Courts and the USCIS. Those entities find persons who obtain citizenship solely by statute to be naturalized.

The big thing that keeps this from happening, doubt those American soldiers went to the U.S. Consulate and registered the birth and received a CRBA and passport for these children.

I am honored to be misattributed just like President I mean Senator Cruz so frequently is.

You'll find no such posting from me. However, Phyllis Schlafly is a great great lady and I'm sure Ted Cruz craves her endorsement.
