Trump University Plaintiff Seeks To Withdraw From Suit, Fearing Public Trial
TPM ^ | March 8, 2016 | ELLIOT SPAGAT

Tarla Makaeff has had enough of Donald Trump after spending six years fighting him in court.

The Southern California yoga instructor wants to withdraw from a federal class action lawsuit that says Trump University fleeced students with an empty promise to teach them real estate. Her lawyers said the Republican presidential front-runner and his team have put her "through the wringer" and made the prospect of a trial unbearable. A judge will consider the request Friday, four days before Florida and Ohio hold their primaries.

Trump's attorneys say the lawsuit should be dismissed if Makaeff is allowed to withdraw, arguing that their trial strategy centers on her. They deposed her four times and identify her as "the critical witness" in a court filing.

Makaeff’s attorneys say Trump’s argument that their client is indispensable to the billionaire’s defense “is illogical to the point of being nearly incomprehensible.” They note the judge allowed two plaintiffs to withdraw last year; three others would remain.

yeah this guy was writing glowing review for Trump U, until he started making bad deals and losing money. Then he wanted to sue.

I would suspect he doesn’t want to go to court where he will actually have to prove anything

Read somewhere that the law firm (who deals primarily with class action cases). Actually recruited some of the plaintiffs.

In all honesty, and taking nothing away from the veracity of Trump’s case, I wonder if they’ve realised (or more likely, their attorneys are realising) that they’d be in way over their heads dealing with a man who is potentially going to be President of the US. I know he’s only supposed to be the “First Citizen” and not immune to the law (saying nothing about this case, about which I know little to nothing), but that hasn’t been the case for generations, or at least since Nixon, and in that case, people much more powerful than these people were dealing with Nixon, including the all-powerful and at that time nearly monolithic leftist media.

There’s only a handful of plaintiffs in this case? Sheesh, all in an attempt to fleece money from a billionaire and take down a political rival. A sure attempt to discourage Trump from getting uppity - they can always slap him down if he thinks of challenging the political order. Reminds me of attempts to charge a popular politician with misusing their office illegally to campaign (not keeping separate the working office and the campaign office as required by law). Said politician suddenly becomes humble. Point is made, don’t run for higher office.

I contend that they have now realized their first mistake was to believe a slip and fall lawyer promising them lots of money. All we have to do is to get them to settle because everyone knows they just want it to go away.

Someone forgot to inform them that Trump doesn’t settle. He is a fighter and this episode that Cruz and the GOPe are trying to smear him with is just another that will now backfire.

I am glad to hear that he doesn’t settle. IMO, all these large corporations and institutions settling with baiters are what has made it difficult for the rest of us, the “little people” to fight encroaching PC.

That dude is a woman. IIRC, her name is tarla and she's a yoga instructor and other crappies. She actually made a video saying how great the seminars were....before she sued.

If she takes the stand, she'll have to perjure herself to win.

Well, you fight the bear. Most days the bear wins.

The Dems will go nuts. But this is how lawsuits work.

I am rarely home on weekday afternoons, but if I am and I turn on the tele I am shocked by how daytime TV is absolutely overrun with ads from ambulance chasers recruiting plaintiffs.

There are only a handful of named plaintiffs -- it's a class action, which means there are numerous other unnamed plaintiffs. The class was certified two years ago, and the case itself was brought in 2010, so it has nothing to do with taking Trump down politically. Fleecing money out of him, perhaps. As he implied last night, Trump would rather pay his lawyers than pay people who sue him.

Which goes to show you he does not care about the “little peoples” money or them, whether he is right or wrong.

He is going to be in for a surprise when he hits Washington.

Guess this is why Trump was so adamant last night that “we are going to win that suit”.

Rubio got these lowlifes to do an ad saying how terrible Trump U was and Trump pulled out the student evaluation forms from them in a video. He held them up and showed how both had given the school 5s oin a scale of 1 to 5 with 5 being the highest. One dope had written 5+++. If he was sworn in he could face perjury charges. Trump wins again because he is an honest man.

The day has barely started and we already have a contender for the most ignorant post.

I worked with someone who did contracts for us but was a lawyer and in her off time she was going around trying to find people to join a class action against some local municipality. She said that if she got enough, she could sell the case to a big firm and let them go squeeze for a settlement. I didn't know a lawyer could sell their case to someone else (ethically) but I gather it's routine in these class action cases.
