The sub was probably already fully surfaced passing through there. The Spanish boat should know better - bouncing off a very think steel submarine hull could be unpleasant. The sub also almost certainly has legal right of way in a restricted channel, since they cannot maneuver.
General Francisco Franco would never have countenanced that.

Spanish speakers seem to have a problem with established borders. The Mexicans are trying to take over Texas and California, the Argentines are trying to take over the Falklands and the Spanish want to take over Gibraltar.
