WASHINGTON The Virginia Supreme Court has struck down executive orders issued by Gov. Terry McAuliffe that would have allowed more than 200,000 felons to register to vote and participate in the November presidential election.
The decision, issued late Friday, requires registrars to strike the names of any felons who registered to vote under the umbrella of three executive orders McAuliffe signed this year. The order gives county and state officials a month to strike those names.
Chief Justice Donald Lemons wrote the decision. Three justices issued dissenting opinions.
In April, McAuliffe restored the civil rights of felons who had completed their sentence and paid their fines. The rights restored included the right to vote, the right to serve on a jury and to serve as a notary. Gun rights are restored through a separate process, which is handled by the courts.
Virginia law grants the governor the power to grant pardons and past administrations have restored the rights of felons on a case-by-case basis. Former Gov. Bob McDonnell and McAuliffe have each tried to accelerate the pace of restorations and to streamline the paperwork intensive and sometimes arbitrary process.

My father was recalled into the Navy early - before June - in 1941, and his ship took him from California to the Atlantic. So my mother took us all to Virginia before September of 1941, where I entered 4th grade. The greatest shock to me was discovering how southern Blacks where treated - Blacks had no right to drink from “White’s only” drinking fountains, to live outside their ghetto areas, to join white kids in school (including Catholic schools), and etc. And now we have a two-term, black president ... disaster! My, how things have changed.
I am shocked by how quickly the decision was released. I think it had somewhat to do with the Governor’s office refusing to release the names.

provides for an exception: No person who has been convicted of a felony shall be qualified to
vote unless his civil rights have been restored by the Governor or other appropriate authority.
Va. Const. art. II, § 1 (emphasis added). On April 22, 2016, Governor Terence R. McAuliffe
issued an Executive Order that inverts this rule-exception sequence. The practical effect of this
Executive Order effectively reframes Article II, Section 1 to say: No person who has been
convicted of a felony shall be disqualified to vote unless the convicted felon is incarcerated or
serving a sentence of supervised release. “
The dissents are pathetic. Illogical and pandering.
He can’t. Executive order can’t do it. State legislature has to make a law.
How many pieces of paper will this take... the autopen can’t hack that problem. Each piece of paper has to be changed out. 5 seconds per piece of paper? This is 11 days with no breaks to sleep. Is he this dedicated. I guess he could, but oh the mockery he would garner.
Did he presume to make a rule that would last for future cases, or only an order that would apply to present cases?
Only if the Federal court puts a stay on it, pending.

Isn't that the general procedure? The thing (law,order,etc) being challenged is assumed to be legal until declared otherwise.I'm not a lawyer so I could certainly be wrong on that.
