Judge rejects Stein's request for hand recount (Judge explains)

Green Party candidate Jill Stein paid $3.5 million Tuesday to clear the way for Wisconsin's presidential vote recount but had a judge reject her lawsuit to require all Wisconsin counties to do the recount by hand.

Dane County Circuit Judge Valerie Bailey-Rihn said the effort to force the hand recount — which was backed by Democrat Hillary Clinton’s campaign — did not meet the state’s legal standard for prohibiting the use of machines in the recount, saying that the two campaigns did not show a hand recount, though more thorough, was necessary or show there was a clear and convincing evidence of fraud or other problems.

Bailey-Rihn said there were good reasons to do a hand recount but no legal basis for her to mandate it.

"I follow the law. That's who I am despite my personal opinions," said Bailey-Rihn, who was elected to the bench last spring. "It's (the counties’) decision. It's their discretion. I may disagree with it … but I must follow the law."

Another bullet dodged. Valerie Bailey-Rihn won her judgeship in an election this April so while her profile was very much that of a Madison liberal, she did her job faithfully according to state law which describes specific criteria that Jill Stein could come nowhere close to meeting.

Maybe it takes time on the bench for the pressure of party politics to turn a judge into an activist, but in this important case, we dodged another bullet.

Some counties may opt to count by hand, as Dane County where Madison is located has, but that has always been a choice that is up to the county clerk. The outcome will be the same regardless.

This is where watchers will be required. If they're going to go for the massive fraud move, it is in these counties being hand counted that it will happen.

Hopefully Governor Walker can stick that $3.5M right into upcoming GOP campaigns in the state. A big hat tip to George Soros for keeping republicans in charge of a dark blue state.

Well, being a demodummie, getting elected in Madison and making the decision she just made, her’s may be a single term. Madison liberals are nasty that way.

Can I just make an observation, that a hand recount may not actually be more accurate?

Human error and fatigue enter into the equation, if they are going to have people laboriously reviewing computer punch cards, or optical scan sheets, or other ballots intended to be tallied by machines.

Then you get into the judgment calls where perhaps a voter left the pres choice blank. Liberals will look at such ballots and say there’s a scratch by the Democrat name, and decide the voter intended to vote Democrat, and add it to the vote total, even though the voter may have intentionally not voted for president.

Every recount I’ve ever known of, has come out with slightly different results each time they count. There is never going to be a perfect total of votes.

Absolutely they BETTER be watching. After all the WI dustup - at end of day, 74% of recount will be by hand. So the dynamics change where the Lib counters can for the 1st time get their hands on the actual ballot and make ‘judgement calls’ - they won’t miss this last oppt’y. 3M votes at 74% = 2.22M votes. Flip 13,600 from DT to HRC...that’s 0.006%. They ARE gonna go for it, and the R’s better have observers big time.

There actually should be a Google, Yahoo, etc. bot out there that translates anything that says “Jill Stein” to the words “Hillary Clinton” because that is what is up with all that.

Yeah, although she probably lost herself a bunch of invitations to really cool people’s Christmas parties. Well, probably more like Kwanzaa or Solstice parties...

When I looked her up yesterday afternoon and saw her hobbies were running and bird-watching I started to worry a bit. I know there are good conservative runners and Audubon members, but probably not many in Madison...

From what I've been reading she's a total "lib" in a mostly "Lib" area.
IF that is true she just lost re-election.

I’m not too concerned after listening to Jim Troupis, who pretty much wrote the recount procedures a few years ago when the first statewide recount in over 100 years had to be conducted. And they’ve modified and improved it since then.

As he says, the number of ballots cannot change. There will always be machine read errors, but statistically they will be spilt among the candidates in the same proportion as the overall vote. A hand recount MAY find some discrepancies but they will not be significant, according to those who have tested and calibrated the optical scanners.

As an old quality assurange manager once (finally) got me to understand, human inspection is on average 80% accurate at best. I had to do the job myself for 20 minutes to realize I was just as capable as the regular operators were at passing a bad part, or making a wrong identification. But the process will guard against that through the granulatity of the count, which will have multiple people looking at each ballot as a cross check.
