Officer placed on leave as DA launches criminal investigation into arrest of Utah nurse

Salt Lake City Mayor Jackie Biskupski announced that as a result of the criminal investigation being launched by the Salt Lake County District Attorney, Detective Jeff Payne will be placed on full administrative leave with pay.

Later Friday night, police stated two employees are on administrative leave. It was not immediately clear who the second employee is.

There won’t be a jury because the city’s liability insurance carrier will be negotiating a settlement.

I'm just SURE that relatives of the DEAD guy the cops were chasing is going to be trying to get some money out of this whole mess; too!

If the LEO is ordering the citizen to do something illegal - to commit a felony - then the citizen not only can refuse, he must refuse.

Sadly, in our haste to be freedom loving we have lost the ability to actually study the law. Your post is the best example from the 5 or 6 criticizing my statement.

Lay persons think that it is the order from LE that has to be lawful. Not so.

It is the lawfulness of the LEO that determines whether a citizen has to comply.

Most of you above are too stupid to get the difference. Well meaning, but stupid.

Let me see if this will help.

If a police officer is properly sworn in, on duty in the jurisdiction of his employment, directing traffic, he is acting lawfully.

And, if he instructs you to drive over the double yellow line (which is illegal) or turn off your headlights, or step out of the car leaving it on the highway in a lane of traffic, he is giving you a “lawful order.” Now, his orders may turn out to be wrong later, but it is not the substance of the order that a citizen may test. It is the authority of the office to give the order.

OK, all cleared up folks?

There is no argument whatsoever. He won’t be blacklisted.

He was unconscious!

He couldn’t give his consent to anything!

Plus, the nurse refused to take his blood. He was not in a position to insist nor go to someone else who would do it.

Case closed.

Not even DOT would have a case, let alone make one.

Why would anyone try and come up with an argument when their own lying eyes showed what happened?

An officer of the law misusing his authority to assault an innocent nurse fulfilling her duties as the hospital proscribed (she had a supervisor on her cell phone telling her not to do it). It’s all in the video.

DOT regulations require CDL holders to submit to a drug test when they are involved in a fatal accident, regardless of the circumstances. This of course does not give a city police department the power to force some random hospital employee to get samples for them.

DOT regulations are not criminal law. The regulations do require a driver to agree to testing, as a condition of retaining his commercial license. Police DO NOT have authority to MAKE the driver give blood.

What are these felonies the officers allegedly committed? I believe they are thugs and should be punished appropriately. But I am ignorant on the felony aspect.

Really. The nurse was between a rock and a hard place. If hospital protocol or law forbids her to draw blood without consent she knew she could lose her job and/or professional license.

Some cops let their power go to their heads. Not the best profession for a person prone to bullying.
