Jonathan Turley: Judge surprises Flynn at sentencing hearing – Here's what to expect next

One could well understand if President Trump’s fired National Security Adviser Michael Flynn was a tad confused.

Sullivan’s harsh attack on Flynn was a surprise. It left Flynn in the position of someone being hit by a train – when the train was miles off its track.

Sullivan also asked prosecutor Brad Van Grack: "Hypothetically could he have been charged with treason?"

Significantly, none of what Flynn and Kislyak discussed had anything to do with alleged Russian collusion.

Yet the judge cited Flynn’s lobbying on behalf of Turkey as an aggravating factor he was considering in sentencing Flynn – despite the fact that this was not being used by the prosecutor as an aggravating factor.

Indeed, various figures like Democratic powerhouse Tony Podesta (brother of Hillary Clinton campaign chair John Podesta) filed the same retroactive declaration under the Foreign Agents Registration Act involving the same underlying work for the same country.

Violations under Foreign Agents Registration Act (until the Mueller investigation) were rarely prosecuted as criminal matters. The vast majority of cases were matters of simple filings and fee payments, or in a few cases civil penalties.

The failure to file as a lobbyist for Turkey under the Foreign Agents Registration Act hardly makes Flynn the modern-day equivalent of Benedict Arnold. It makes him the Republican version of Tony Podesta, who is enjoying his retirement in his home in the upscale Kalomara neighborhood of Washington a few doors down from the former President Obama and his family.

Moreover, it is hard to believe that Quinn would have looked kindly upon the decision of FBI Director James Comey to ignore the longstanding protocol of contacting the White House counsel before interviews like the one conducted with Flynn.

The judge is clearly a dumbass. Treason has a very specific definition in the American Constitution, and our law. Making war against the United States, and giving Aid and comfort to an enemy. Who does this dumbass judge think we’re at war with? And how did Flynn assist an enemy of the United States?

Another affirmative action judge if you ask me

That sounds a bit like a bank robber's sentence being impacted by the fact that he also once had a restraining order for domestic abuse.

It's a great quote, but I look at it differently ...

Working as a foreign lobbyist while serving as a national security adviser for the presidential campaign of Donald Trump -- of all people -- makes him 'effing retarded.

Basically, the judge seems to be saying, “He’s innocent of what he is pleading guilty to, but there are other, more severe things that he might be guilty of doing. And none of what he is accused of doing relates to Trump or Russia.

It doesn't matter.

I'm not talking about a legal problem for Flynn with his work for Turkey. I'm talking about the awful optics of working for a totalitarian Islamic government in Turkey while serving as a senior adviser on national security matters for a nationalist "Make America Great Again" presidential candidate.

What the f#&% was this guy thinking?

Every player in this fictional tragedy wants to be THE star of the show... here comes the judge now trying to up stage Comey for air time on MSM to see who can be the biggest clown. Am sick of it all and ashamed of the republicans’ inaction... only questionable lip service.

Right -- I should use different language here.

Flynn was working as a lobbyist for a foreign government while working as an adviser to the Trump campaign on national security matters, not as the National Security Adviser in the Trump administration.

I'm not suggesting Flynn's work for Turkey was illegal (let's assume he was properly registered as a foreign lobbyist for the sake of this discussion). I'm suggesting the political optics were awful for Trump.

Just heard Joe Digenova about 30 minutes ago on the Howie Carr Show (out of Boston).He was surprised and disappointed by Judge Sullivan today.He said that while he was a young federal prosecutor years ago judges would never have allowed him to get away with what Judge Sullivan is allowing Mueller & Pals to get away with.
