I call BS on this. I’ll do an internet search but I believe the President has signed legislation guaranteeing back pay. And I believe OPM has already said RIF procedures won’t apply. I’ll try to find some links.

A lot of drama here. It’s quite entertaining. Guess who has the upper hand? All that for a ‘measly’ 5 billion. I say up the ante to the full 25.

He did sign the bill, but he can RIF if he wanted to. OPM would need to initiate an action, have it reviewed, (etc), but it ‘could’ be done.

You are correct. With the signing of the back pay legislation it shuts down the option of a RIF. Depending on the length of time this goes on, many may self-eliminate.

I’m sure the 9th Circus would love to straighten out any nuances of legal interpretation regarding this issue.

If he starts laying people off, then it seems that they only “back pay” they would be eligible for would be for that work they did before the layoff.

After day 30, a 90 day process begins. If he plays by the book, he can eventually make some progress in trimming the fat.

Here is an excellent source on this topic:

If someone here wants to debate the OMB, go for it... :-(

Funny how they’re all about back-pay when it doesn’t involve DoD. When the sequestration furloughs in the summer of 2013 hit (which no news agency ever talks about, to them it never happened), they were more than happy for DoD employees to lose a month’s pay and tell people to suck it up, buttercup. Since DoD is funded this time around, all of a sudden it’s a big sob story, of course they’re getting back-pay, banks are giving free loans, let’s go on the TV every night and have a good cry for them. The game is a lot different when it’s DoD taking the hit, which is usually what happens.
