Giuliani says in deposition he 'didn't have the time' to verify election claims: CNN

Rudy Giuliani, who served as Former President Trump's personal attorney, said during a deposition in mid-August that he “didn’t have the time” to look into whether reports of election fraud were credible, CNN, which obtained deposition tapes, reported Friday.

Giuliani is being sued by Dominion Voting Systems after he and other defendants connected to the former president repeatedly made claims, without evidence, that the 2020 election was rigged by Dominion Voting Systems in favor of Joe Biden.

“We had a report that the heads of Dominion and Smartmatic, somewhere in the mid-tweens, you know 2013, 2014, whatever, went down to Venezuela for a get-to-know meeting with [President Nicolás] Maduro so they could demonstrate to Maduro the kind of vote fixing they did for [former President Hugo] Chavez," Giuliani is shown saying during his deposition footage.

“Our automated election system is designed to make it evident when results are manipulated, however, there must be people auditing the system and watching for that evidence. During the National Constituent Assembly elections there were no auditors from the opposition parties as they did not want to participate.”

“In addition, in all elections held in Venezuela since 2004, all political parties have received printed copies of the election returns of all polling stations. When the election commission publishes the results on its website, precinct by precinct, it is very easy to compare all these printed records against the results published by the elections commission.”

“Furthermore, the total sum of all election returns must coincide with the final results published by the National Elections Council. This auditing mechanism allows all parties involved to prevent any type of manipulation in the transmission, tallying and publication of election night reports. This protocol has been followed in all Venezuelan elections since 2004, except for the election last Sunday, because the opposition didn’t participate.”

“An audit would allow everyone to know the exact participation.”

CNN is probably taking the Mayor out of context.

If not then Rudy might as well cut that billion dollar check for Dominion now.

“The voting machines used in Venezuela are touch-screen direct-recording electronic voting machines (DREs) that produce a paper receipt for the ballot once the ballot choices have been made. In the 2012 presidential election, voters were also authenticated using a biometric authentication device. After casting their ballots, voters are able to check that the paper receipt matched the selections they had made on the electronic voting machine. The voter then placed this paper receipt into a ballot box in the polling station.”

“While the voting machine itself tallies the votes and produces the results for the polling station, the paper record in the ballot box enables verification that this electronic record is accurate. This verification method is used extensively in Venezuela, with over 50 percent of randomly selected polling stations counting the paper records to ensure that they match the electronic results. This “hot audit” is conducted immediately after the close of polling and in the presence of observers and party representatives. No significant anomalies between the paper and electronic records have ever been found.”

“The source code for the electronic voting machines is audited before each election. Technical teams assembled by government institutions, independent institutions and political parties review the source code line by line in a ‘clean room,’ where code can be viewed in its entirety but not modified or taken away.”

Giuliani accepted hundreds of sworn statements from poll worker eye witnesses.

How was he supposed to verify every one, other than to have them sign the statements under penalty of perjury?

I mean, that's the whole point of having a sworn statement in the first place.

If someone asks me, I believe Dominion allowed errant entries to force things into this admin adjudication process. That is what feasibly makes sense and there were a few videos showing how powerful the processor becomes when in that mode.

I do not believe the stories about hacks from overseas. And I think that is just allowed to propagate just enough because it makes people seem crazy, especially when those stories are dressed up with sexier conspiracy theories.

Much like how the USAF when testing something would rather people claim they saw a UFO, but describe it as a flying saucer, so someone else will think “ho hum this again” and won’t investigate further.

I do though, believe something happened and either ballots were deliberately damaged or blank ballots brought in and run through, in places, to make up the differences.

“Moles and trolls were spreading those rumors, either for clicks or as deliberate information to make the pubs look like fools.”

The rumors probably can be traced back. The results may be very, very interesting.

The feds seized Giuliani’s electronic devices back in late April, so they exist and have been secured.

“blank ballots brought in and run through”

Most likely heavy ‘rat batches were run through twice.

Google seems to indicate Rudy is worth about $45 million.

I’m sure the parties check local results against consolidated results.

Yep...and there was so much material that actually was provable as occurring and tangible...but none of that was discussed or focused on - just the most outlandish wild conspiracies which drowned out what would have been very credible causes of concern.

I generally think Giuliani was shoveling a lot of BS (more in his claims to the media than in his court filings), but he's absolutely right in his answer here. When signing a pleading, the lawyer is not guaranteeing that everything in it is true. He is saying that he has a good faith belief that the allegations are true after a reasonable inquiry. As the US Supreme Court has held, the "standard is one of reasonableness under the circumstances." Those circumstances include, as Giuliani points out, time pressures such as those in an election challenge that will quickly become moot.

there were lawyers here who volunteered to help. they were turned down...not by Trump but those in the chain. at least two posters here

I am one of them. I wasn't expressly turned down, but I was in communication through two separate organizations--one specifically working in Georgia--and had offered to travel anywhere they wanted on my own dime. I got nothing other than responses from the general counsel of one of the organizations, when I followed up, that they were "surprised" I had not heard from the campaign.
