Gay psychiatrist must repay U.S. Air Force

SAN FRANCISCO - A gay psychiatrist ordered to repay the U.S. Air Force $71,000 for his education argued to an appeals court Wednesday he doesn't owe the government anything and the military's policy is discriminatory.

Dr. John Hensala, 38, attended medical school at Northwestern University, served his three-year residency at Yale University and received a two-year fellowship at the University of California at San Francisco - all with the understanding that, in exchange, he owed the Air Force four years of active duty service.

I suspect the district court decision will be overturned. There is no rule against "telling." Nor is there any rule against not telling. This one isn't even close.

As a matter of equity the court is not going to allow a man to unilaterally exercise a power to avoid service and keep the money expended by the Air Force's in the reasonable reasonable expectation that he would serve

The legal doctrine is one of unjust enrichment.

BWAHAHAHAHAHAHAHAHA! This case made me think of Klinger in MASH. That malingering soldier tried everything to bail, including crossdressing. And what a shame that this fellow has to pay his loans back. I wonder how he will like dealing with HMO's? Payback is a Hillary ain't it?
