Some Democrats say they began the filibusters to force Bush to consult with them and to select nominees with more moderate views. Yet both conservative and liberal senators and activists say that the 10 successful filibusters waged by Democrats have not swayed Bush, and may even have stiffened his resolve, raising the question of whether Democrats overplayed their hand.[. . .]Replacing Rehnquist with a conservative would not change the balance of a court that has voted 5-4 on many hot-button issues. But replacing a moderate or liberal would tilt the court to the right.[. . .]The fight over rules for...

According to senate minority leader Harry Reid and his friends, democrats must block the constitutional appointment process in order to protect you from right-wing radical judges. They say they use the filibuster only in the most extreme situations, to block confirmation of extremely dangerous radicals to the bench for sake of all mankind. Hero’s they are really, at least in their own minds… I can almost see their point too. Who would want some extreme right-wing wacko deciding justice in America? I mean, what if judges actually just stuck to the written law or constitution and applied them to cases...

Instead of a magic wand, Harry Reid uses his mouth. And in place of fighting on the side of good, Harry readily and passionately embraces the dark forces. As Senate Minority leader, Reid has already taken the Democrat art of obstructionism far beyond that of his predecessor Tom Daschle. And in a manner similar to the infamous and ongoing Howie Dean screams, no Republican is safe from his rantings and invented falsehoods. Harry’s once quick smile has turned into a leer and his demeanor has degraded to that of a permanently enraged and deranged man. Yikes! His apprentice training is...

Bill Clinton Left A Few Stinkers - Over 370 Fed Judges That aroma wafting across the United States that could make one very ill if inhaled is not some imaginary pollution invented by the EPA or lib college professors, it is the smell of bad law made by Clinton appointed judges. The idea of 'One Man, One Vote' has been replaced by 'One Judge, One Million Votes' as federal judges continue to strip the power of referendum voters away from the common folk. This week, the Nebraska federal judge Joseph Battalion, who has just negated the wishes of 70 per...

WASHINGTON - With a showdown looming over President Bush's federal court nominees, Democrats and Republicans discussed compromise offers and counteroffers yesterday - some in public, some in private - that many lawmakers hope might defuse a conflict over the use of filibusters. Two leading senators - a Democrat and a Republican - urged their colleagues from the chamber's floor to lower tensions over blocked confirmations by moving ahead on nominees that Democrats oppose but have pledged not to filibuster. A third senator, Democrat Ben Nelson of Nebraska, said he was working privately to round up six of his Democratic colleagues...

LOUISVILLE, Ky. (BP)--Believers must exercise their Christian citizenship beyond the ballot box to halt activist judges and secularist senators who are robbing Americans of their religious liberty, R. Albert Mohler Jr. told a nationwide audience April 24 during “Justice Sunday” at Highview Baptist Church in Louisville, Ky. Mohler, president of Southern Baptist Theological Seminary, was one of several speakers at the event, which was designed to mobilize Christians to action against judicial filibusters, which Democrat senators have used to block 10 of President Bush’s appellate court nominees. In most of the cases, senators objected to the nominees' pro-life views. The...

The best way to understand the brouhaha over the Republican plan to invoke the constitutional option to prohibit Senate filibusters to thwart judicial nominations is that Democrats are very poor losers, but Republicans are even poorer winners -- so far. The reason we're even talking about a so-called " nuclear option" is that Democrat leaders remain in denial about their consistent drubbing at the ballot box. They won't accept that the public has rejected their message. They are acting like the ornery little brother who hits his older brother, and when big brother merely threatens to hit back, he goes...

IN RECENT DAYS I interviewed Nan Aron, president of the Alliance for Justice, and Ralph Neas, executive director of People for the American Way. Together these two are the architects of the policy of unyielding obstruction by Democrats of George Bush's judicial nominees. It is difficult to overstate their influence on the Democratic caucus: They are widely considered to be the hands steering Democratic policy on judges. Both blew the usual rhetorical smoke about how well President Bush is doing with his judicial nominations--Bush has by far the lowest approval rate to the appeals court for modern times for a...

Email from Democrat Harry Reed follows. This appears to contain extreme hate speech and bigoted ad homonym attacks. Dear supporter, Today I stood in front of the Supreme Court and collected more than 1 million petitions from people all across America. Standing there, I heard your voices urging the Senate to reject any attempt to do away with the system of checks and balances our founding fathers created to protect the rights and voices of all Americans. I want to say thank you for standing up and lending your voice to this debate. Republicans want to go "nuclear" and turn...

SAN FRANCISCO (AP) - Gov. Arnold Schwarzenegger tapped 11 attorneys with a variety of legal backgrounds and political affiliations Wednesday in a bid to fill dozens of trial court vacancies in Los Angeles, Sacramento, Fresno and San Bernardino counties. Tapped to the Los Angeles County bench are Eleanor Hunter, 43, a Democrat and Los Angeles County prosecutor of Los Angeles; Michael Lavanas, 55, a Democrat and Los Angeles county court commissioner of Pacific Palisades; Scott Millington, 44, a Republican and Los Angeles County prosecutor of Manhattan Beach; and Dorothy Reyes, 52, a Democrat and insurance defense practitioner of Pasadena. To...

The pre-spin: Bush will spend about 1/2 the speech on foreign policy, 1/2 on domestic, with heavy emphasis on Social Security reform. It's said he will provide a detailed tutorial on the SS system and its problems with a few details on his personal accounts proposal. Laura's guests are said to be an Afghan voter and an Iraqi voter (too bad there's no Ukrainian wearing an orange hat!). Should we start a drinking game on how many times the pool camera swings to Hillary? Hmmm. Probably not...it would likely hamper out typing ability. Word on the blogs has it that...

My son is taking a US history course in college and the discussion came up of all the judges that Clinton appointed during his term. The instructor said the vacancies were caused by retirements. It seemed very convenient. My question is: was there some widespread motivation that moved a huge amount of federal judges to retire and Clinton to thereby appoint over 350 judges? Please give references to your answers.

WASHINGTON — The Senate's Democratic leader said Sunday that Republicans "would rue the day" if they try to make it harder for Democrats to stall judicial nominees who could not get a vote last year. But Majority Leader Bill Frist, R-Tenn., said he hoped a new "optimistic" climate would take hold now that Nevada Sen. Harry Reid is the top Democrat, succeeding the defeated Tom Daschle of South Dakota, whom the GOP labeled an obstructionist.

Chief Justice William Rehnquist's health is so poor he likely soon will be called to the Great Appellate Bench in the Sky. On NBC's "Meet the Press" program last month, the new Senate Democratic leader, Sen. Harry Reid, said he could support the elevation of conservative Justice Antonin Scalia to chief justice, but not Thomas. Angela Onwuachi-Willig, a liberal Democrat and law professor who is black, said Reid's erroneous attack on Thomas appeared to be motivated by racism. "It is the black justice who cannot write opinions, articulate independent thoughts or perform his job well," she said, writing in the...

Article II, Section 2 of the U.S. Constitution relates that "He [The President] shall have Power, by and with the Advice and Consent of the Senate, to make Treaties, provided two thirds of the Senators present concur; and he shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by Law..." So what does all that mean exactly? Well, the first part means...

WASHINGTON (Reuters) - U.S. Trade Representative Robert Zoellick is expected to be named deputy to incoming Secretary of State Condoleezza Rice later this month, a Bush administration official said on Thursday. The official said an announcement was likely after Rice's confirmation hearing scheduled for Jan. 18. Zoellick had also been mentioned as a candidate to replace World Bank President James Wolfensohn who told the bank this week he planned to leave in June. As Deputy Secretary of State, Zoellick would replace Richard Armitage who resigned when Colin Powell announced he was quitting soon after President Bush's re-election in November. Zoellick...

WASHINGTON - Chief Justice William H. Rehnquist is back at work part time at the Supreme Court, but there is no word that he is ready to return to the bench. Rehnquist missed about 25 court arguments in November and December while receiving chemotherapy and radiation for thyroid cancer. A Supreme Court spokeswoman said Wednesday that the 80-year-old chief justice returned to the building late last month. "He's been working from both the court and home," spokeswoman Kathy Arberg said. Few details have been released about Rehnquist's condition. The chemotherapy-radiation treatment is common for the aggressive and life-threatening type of...

If Chief Justice William Rehnquist retires next year, President Bush likely won't face a tough battle over his successor. So reports the New York Times, citing consultant Howard Wolfson and "other Democrats." The Times attributes this to the Democrats' desire to soften their image as pro-abortion zealots. The court has a 6-3 majority in favor of Roe v. Wade, and Chief Justice Rehnquist is among the dissenters. Why should the Democrats spend political capital merely to run up the score? Anyway, this is a battle the Democrats would almost certainly lose. With only 45 senators..., they would need the support...

Political operatives on both sides of the aisle are discussing the 2008 election as if it is only days away. But hardly a dismissal of the important issues facing President Bush in his second term, this talk of the next presidential race is representative of the pivotal changes in the political landscape that occurred last November. Unfortunately, the forces of “moderation” are still at work within the GOP, threatening to undermine the tremendous gains made by conservatives in the elections. Arnold Schwarzenegger contends that the Republican Party should move “to the center” (which means to the left) on social issues....
