DA Bragg’s case is in serious trouble. The gang behind the prosecution of President Trump made a serious error that should lead President Trump’s team to move to dismiss. [Prosecutors in New York have revealed what the other crime is that Donald Trump was allegedly trying to conceal when he was falsifying business records and they claim it was to unlawfully promote his candidacy. The fatal error is that the NY Statute they cite only applies to elections within the State of New York and not Federal Elections! Trump was running for the federal office of President of the United...

The panel affirmed the district court’s dismissal for lack of standing of an action, brought before the 2022 general election by former Republican nominees for Governor and Secretary of State of Arizona, alleging that Arizona’s use of electronic tabulation systems violated the federal Constitution. The gravamen of Plaintiffs’ operative complaint is that notwithstanding safeguards, electronic tabulation systems are particularly susceptible to hacking by non-governmental actors who intend to influence election results. On appeal, Plaintiffs conceded that their arguments were limited to potential future hacking, and not based on any past harm. The panel held that because Plaintiffs are no longer...

A judge on Monday dismissed the only remaining legal claim in Republican Kari Lake’s challenge of her loss in last year’s race for Arizona governor, affirming the election of Democrat Katie Hobbs. Maricopa County Superior Court Judge Peter A. Thompson said Lake failed to prove her claim that Maricopa County did not verify signatures on mail ballots as required by law. Lake was among the most vocal of last year’s Republican candidates promoting former President Donald Trump’s election lies, which she made the centerpiece of her campaign. She has built a loyal following among Trump supporters and is openly considering...

On the second day of her dream vacation on exclusive Bald Head Island, Julie Mall went with her family to the beach to catch the sunset. Her 11-year-old son asked to drive the golf cart back to their $1,000-a-day rented cottage. It was dusk, no traffic on the path and his father would sit next to him. A two-block, 30-second ride. She said sure. What could go wrong? In the next four hours, Mall says she was pinned to the ground by police, repeatedly accused of being drunk, frogmarched barefoot aboard a ferry in handcuffs, jailed in leg irons and...

District Attorney Ed (the barbarian) Berberian was slapped down by another judge in the Dr. Simon self defense shooting case. The shooting occurred in Marin County, an environment notoriously hostile to the Second Amendment. From marinij.com: Judge Andrew Sweet dismissed “in its entirety” a grand jury indictment lodged against Dr. James Simon, saying District Attorney Ed Berberian “made an inappropriate presentation to the grand jury” that failed to tell jurors relevant details about the case, or told them details that had no relevance at all. The result, said Sweet, was “substantial prejudice.” Had Berberian proceeded appropriately, “it is reasonably...

BOUNTIFUL — A judge ruled Monday that a former Davis High School teacher will face separate trials on charges of sexually abusing three students. Brianne Altice, 35, faces a total of 14 felony charges — including rape, forcible sodomy, forcible sexual abuse, unlawful sexual activity with a minor and dealing in materials harmful to a minor — stemming from alleged sexual relationships with three former Davis High students who were 16 or 17 years old at the time. Second District Judge Thomas Kay ruled Monday that it was "appropriate and necessary" to split the 10 original charges into three trials,...

CHARLOTTE, N.C. (AP) — Police in Charlotte are unraveling a home invasion and burglary that ended with a 15-year-old suspect shot to death on a nearby street. It is not the sort of appointment Gordon Brown would make to his cabinet. But then Mr Brown is no Silvio Berlusconi, playboy and man of ostentatious political gestures. The Italian prime minister, long known for his fondness for pretty women, has named former topless model and beauty queen Mara Carfagna as equal opportunities minister in his new cabinet. Miss Carfagna, 33, turned to politics after a career on TV following her sixth-place finish in the 1997 Miss Italy contest. She has also posed topless and semi-naked for photoshoots but has always underlined her family values and stressed none of...

The motion also says the alleged victim told Durham police that she had performed for a couple at a Raleigh hotel hours before the Duke lacrosse party. She told police that she used a vibrator. Osborn suggests that could be the source of the vaginal injuries mentioned in the rape kit report. (snip) Osborn says the accuser gave conflicting accounts of what happened. The motion says medical records indicate she told a doctor that she used no alcohol or drugs. The accuser told the sexual assault nurse that she had consumed one drink of alcohol and was taking Flexeril, a...

A US judge today dismissed a lawsuit against former CIA Director George Tenet by a German of Lebanese origin who said he was abducted and tortured by the American spy agency. US District Judge TS Ellis agreed with government arguments that moving forward with the case of Khaled el-Masri would risk national security by exposing state secrets about CIA activities vital to the US war on terrorism. "While dismissal of the complaint deprives el-Masri of an American judicial forum for vindicating his claims ... el-Masri's private interests must give way to the national interest in preserving state secrets," Judge Ellis...
