BETHESDA, Md., April 8, 2016/PRNewswire/ — Ted Cruz risks primary disqualification in New Jersey resulting from charges of ballot access fraud. A primary ballot disqualification hearing is scheduled by the Secretary of State for Monday, April 11 at 9:00 a.m. in Mercerville, New Jersey.
Washington D.C. Law Professor Victor Williams charges that Ted Cruz fraudulently certified his constitutional eligibility for office to gain ballot access. Williams demands that Cruz be disqualified from several late-primary ballots: “Cruz committed ballot access fraud in each state when he falsely swore that he was a ‘natural born’ American citizen.” Cruz was born in Calgary, Canada and held his resulting Canadian citizenship until May 2014. Professor Victor Williams is a little-known candidate for president of the United States in 2016 whose name may soon become a household word. He is on the ballot in nine states and has chosen to use his “Competitor Candidate Standing” to potentially strike and disqualify Canadian born Ted Cruz from 8 State Ballots. Williams, an attorney and law professor, also pledges he will litigate to invalidate fraudulent elections should Ted Cruz not be disqualified.
Each filing alleges that Rafael Ted Cruz obtained ballot access by fraudulently, misrepresenting his eligibility as a Canadian-born, and not a natural born American citizen. Each charge demands that the Secretary of State provide Williams with immediate remedy for ballot fraud in specific ways.
New Jersey may be of concern for particular concern for the Canadian immigrant. On April 8, 2016 Mr. Williams posted an alert on his campaign website headlined “Ted Cruz risks primary disqualification in New Jersey resulting from charges of ballot access fraud.”
He goes on to detail that a primary ballot disqualification hearing has been scheduled by the Secretary of State for Monday, April 11 at 9:00 a.m. in Mercerville, New Jersey.
The alert states, “Williams demands that Cruz be disqualified from several late-primary ballots: ‘Cruz committed ballot access fraud in each state when he falsely swore that he was a ‘natural born’ American citizen.’ Cruz was born in Calgary, Canada and held his resulting Canadian citizenship until May 2014. Cruz may not even be a naturalized US citizen as he has not provided that proof either and has been unwilling to do so. We’ll hopefully learn the truth in that regard on April 11th as well.
According to the post, “Williams’ fraud charges had quick effect in New Jersey. Rather than accepting Cruz’s ballot petition when filed last week, the Secretary of State (Kim Guadagno), scheduled the unusual Administrative Law hearing for April 11. The Canadian-born Cruz must prove that he did not falsely certify his eligibility for office.
Cruz’s ballot eligibility is also being challenged in California, Maryland, Montana, Nebraska, Oregon, South Dakota, and Washington.

You can repeat your eccentric definition of NBC a million more times and it STILL won't be correct. If it were, it would be time to get such an embarrassment out of the constitution. I knew Paul Manafort in Connecticut. He is enough of a talent to re-organize Trump's disaster of delegate management, maybe even to get Trump nominated, but he ought to be ashamed to associate himself with such a totally tawdry campaign. When the convention meets in Cleveland, watch the following four individuals with whom I am acquainted. Three of them may be our last best hope and I only really admire one.
Paul Manafort who will run Trump's convention operations as best they can be run. He comes on board late when many blunders are already history. He is quite competent and grinds it out three yards at a time. Trump has chosen well in hiring him. A hunger for power and money are his Achilles' heel and are inconsistent with Trump's chosen image. He is very likely to perform well nonetheless.
Charlie Black who will run Kasich's convention efforts and will serve as the undertaker to Kasich's ambitions but maybe cut Kasich the best deal he can. Charlie is very capable but lacks adequate self-discipline to be all that his considerable talents would allow him to be. The Kasich campaign is a small stage on which Charlie may be able to surprise folks. I expect that Kasich is doomed in spite of having Charlie on board.
Roger Stone, in charge of disinformation and running the dancing bears and distractions in the streets to keep the public's attention far, far from reality. If Trump has two living brain cells to rub together, he will keep Roger a continent away from his campaign since Roger is an automatic embarrassment of Biblical proportions.
Finally, there is long-time Virginia Republican National Committeeman Morton Blackwell, the most experienced and principled and capable of the four. He is with Cruz.
Those four (or three if Stone is excluded or two if Black is also excluded) will sit down in any crisis, recognize reality and act accordingly. If, for any reason, they do not, you can kiss The Don and the Wall Almighty and the nation goodbye.
Conservatism will survive even if forced underground. One cannot say the same for Trump and his Amateur Hour. Manafort will survive no matter what. Unless he succeeds in making a very attractive deal, details to be determined, Trump will prove as lasting an historical force as The Barefoot Boy from Wall Street, another liberal amateur, Wendell Willke who was nominated and shellacked in 1940. When November rolls around, Trump will HEAR the magic words: You're Fired! Even if he takes fellow celebrity lightweight Kim Kardashian as his running mate.

Statutes are relevant only if they are enacted pursuant to the constitution. It seems that one's constitutional right to be regarded as an NBC is not a creature of statute. If Congress MUST pass a law conferring citizenship, it would be naturalized (after birth) citizenship.
As to those BORN as American citizens as was Cruz, Barry Goldwater, possibly George Romney, possibly Mitt Romney depending on whether his father was a citizen at all but his mother seemed to be a citizen, Lowell P. Weicker, Jr., Barack Insane Obozo, Congress lacks jurisdiction to "naturalize" those already citizens, i.e. born in the United States of parents not foreign diplomats, and/or at least ONE parent an American citizen. Chester Arthur was apparently born in Canada of Canadian citizens, not just accused of it by sleazy operators like Trump. The nation survived.

OK, Trump may win the nomination with his despicable tactics and more despicable track record. If the polls mean that he will win the nomination, they also mean he gets his ass kicked in November by such lowlifes as Hillary or Bernie. Satisfied? Well, of course, The Don is apparently now also an NBC at least just like Hillary and Bernie and only a smidgeon more qualified ideologically.
I also don't obsess over the false god of The Wall Almighty. We need it after the last eight years but it is fool's gold to trust The Donald to actually get it done and you can bet your bottom dollar that the Mexicans are not paying for it.
I don't like the trade deals but I also don't much care for trade wars such as the one that triggered The Great Depression. A modest promise to abrogate NAFTA, WTO, TPP and such will suffice and will help restore American sovereignty.
If Trump is all that is left in November other than Comrade Grandma or Comrade Grandpa, I will apply a vise to my nose and likely vote for him and feel an instant sense of profound shame. This is not yet a permanent decision. If against all odds, he is elected, and against even steeper odds, governs decently, I will be the first to admit I was wrong. I cannot realistically foresee having to do so. Far too many IFS between here and there.
Anything The Donald might do that is worthwhile is more than I expect of him. The best that can be said of him is that even he is not Moral Monster Mitt Romney. I do not want any part of sacrificing the conservative movement and therefore my nation on the altar of the false gods Donald Trump and the Wall Almighty.
How many Republicans will walk away in November unless Trump and his loveslaves clean up their acts? We shall see. Ask President McCain and President Romney how it works out when such realities are ignored.

Looking at the bills presented in Congress concerning natural born citizen, though not passed, will give you a perfect example of who is not a natural born citizen.
They wouldn't need to change/add something if was already in place.

Why did the law need to be changed and why did `natural born' need to be inserted if they were already natural born?

One citation to Vattel's theories was the English translation from the original French, 1797 in English, 1757 in French, the English ten years after the constitution became effective so it could not have served even as "persuasive" much less binding as an inspiration to the constitutional convention.
It does not matter that the justices in the oldest case had served in the revolution much less that their daddies had. That has nothing to do with the quality of their decision. Any reference to NBC was DICTA not a holding of the SCOTUS or a precedent. Do you know what DICTA means in the context of SCOTUS decisions? Bupkus. Furthermore, The Venus case was apparently (according to the cited article) NOT about NBC qualifications at all but on the entirely different matter of what happens to a ship's cargo when the ship is seized as a prize. This would be a case at admiralty and not even part of the ordinary system of law. Admiralty is quite different and is one of the very few genuine specialties recognized in the profession along with patent and copyright. DICTA has as much to do with that case, as a precedent, as would have been words that observed that the decision was handed down on a sunny day.
Minor vs. Happersett is a particularly inapt precedent in that it is about a woman suffragette suing Missouri claiming a legal "right" to register and vote. The SCOTUS of that time ruled, in accordance with law, that she was NOT entitled to register or vote and that was because she was a woman and because women were allowed to do neither. Any DICTA about her citizenship are merely that: DICTA and not at all precedent for the current "controversy."
Shanks is a case determining whether the estate of a father who was a South Carolina "colonist" would go entirely to one daughter who was a South Carolina colonist at the time of her birth to a father who adhered to the revolution and died an American citizen and a South Carolinian for her entire life or whether the estate would be divided between her and her American born sister who subsequently moved to England in 1782 and became a British citizen. With scant few details, we are left to imagine that a claim was made that the sister who had moved to England was challenged as ineligible to inherit because of that simple fact. The DICTA in that case indicate that it may AT LEAST be said that each of these sisters who were born IN South Carolina of a father who was of South Carolina and father and daughters all lived in South Carolina after the revolution until one moved in 1782, were thereby citizens of the United States by their birth in a predecessor colony and by the nationality of their father. I will go out on a limb here and state my suspicion that (1) this does not limit such citizenship as is conferred by birth IN the United States OR by having one parent an American citizen and (2) that no one born in the pre-Revolution colonies is still in shape to litigate such questions. The SCOTUS divided the estate.
Finally US vs. Wong Kim Ark born in the US to two resident alien parents. Some customs pecksniff tried to prevent Wong Kim Ark from returning to the United States after a trip to China. SCOTUS ruled that, born in the United States, Wong Kim Ark was a citizen without further ado though neither of his parents were citizens and ordered him admitted to the US. Just how that is imagined to support perpetually offended politically fundamentalist "constitutional" Birtherism is beyond me. It said Wong Kim Ark was a citizen by birth and not that one must be born here or how many citizen parents one must have if not born here.
Also the website seems to exist to perpetuate Birther heresies as reflected in reader responses and in the 2009 date of the article which suggests that they were a day late and a dollar short on stopping Obozo and apparently the Birthers do not want such shoddy work to go to waste.
Do you really wonder why the courts give this nonsense short shrift?
Lest I seem unfriendly, and in the interest of full discussion, Freeper "Cboldt" with whom I disagree on this stuff is an attorney who apparently has litigated such questions. He has a lot more recent SCOTUS decisions that you may find more useful, has the benefit of a track record here for integrity and candor, and much better advocates your position than this sorry newsletter. You should check in with Cboldt for far better sources.
