Ginsburg Says Senators May Be Disqualified to Vote on Impeachment [semi-satire]

Supreme Court Justice Ruth Bader Ginsburg says that US Senators who are not impartial can be disqualified from participating in a vote to convict or acquit President Trump in an impeachment trial.

"A number of Republican senators have already expressed opinions about the House articles of impeachment," Ginsburg said. "Allegations asserting that 'abuse of power' or 'obstruction of congress' are not impeachable crimes shows bias that should lead to ejection from the jury that will decide on the verdict. This stands in stark contrast to the 230 votes in the House affirming that these acts are crimes and the overwhelming testimony of witnesses in whose opinion the President did commit crimes. I would expect Chief Justice Roberts who is the one who will preside over the trial to exclude any senators who have publicly rejected this evidence from being allowed to vote on whether to convict the President for these crimes."

Rep. James Clyburn (D-SC) said he concurred with Ginsburg's view. "I say, let's give him a fair trial and hang him. That's the only way we'll avoid the kind of kangaroo court farce that the Republicans would give us."

Rep. Jackie Speier (D-Calif) called on Senate majority leader Mitch McConnell "to recuse himself. In fact, any prospective juror who has an affiliation with the accused should be barred from being on the jury. I think, that would require every Republican—members of the same political Party as the President—to be prohibited from participating in the trial."

I recall Ginsburg also making a very negative comment about Trump during the election.

HA! Actually, Roberts should be disqualified since he was responsible for the FISA court, and that’s a conflict.

He must resign as Chief Justice, so that someone else can conduct the Senate trial as Chief Justice, without the conflict.

I’m hoping that GOP oppo research has clips of every Dem Senator who has ever expressed an opinion on impeaching Trump. The Democrats had 26 seats up in the last election, the GOP had 9, the GOP won 2 seats so the Democrats successfully defended many seats when impeachment was a campaign issue, to say nothing of the Chuck Schumer’s of the world who should be on everyone’s naughty list for tanking the anti-surprise medical billing legislation that POTUS wanted to go through.

Also there is the matter of the Democrats and media helpers trying to force all Republicans to weigh in on impeachment as a part of their election strategy. When we are talking about representatives of the public representing a position, how do you sort the people who were speaking for their constituents from the people who were speaking for their donors from the people who were speaking for themselves? Surely this is a consideration. The POTUS hardly exists in a vacuum, and if anything the Supreme Court has complicated this problem with all of the dark money that their rulings have unleashed upon this country.

At the very least, any senators running for president should recuse themselves from any impeachment vote due to a serious conflict of interest.

Every lawyer in Congress must recuse oneself from any congressional business whatsoever.
