Everything about the case in New York City against the Trump organization business operations is ridiculous. There are no victims. There was no fraud. All of the lenders did their own due diligence. All of the loans were paid back without issue and the statement of financial condition was factual and accurate.
Additionally, the statute being used as the predicate for the case is a consumer fraud statute, intended to protect borrowers from predatory lenders. In the four corners of this case, Trump is the borrower, and the banks were the lenders. New York is flipping the statute to claim the borrower defrauded the lenders, despite the lenders denying there was any fraud and there was no harm. The entire case is ridiculous.
In a properly functioning legal system, this judge would be stopped or removed by a prerogative writ such as mandamus or prohibition. It is a waste of judicial resources for it to continue. “Judicial economy” requires that it end. Everyday it continues is another day that a serious criminal case is delayed. There is a clear political agenda from the judge and prosecutor.
Didn't Trump also have a “disclaimer clause” about his valuation?
It said something about the valuation may be wrong and that the bank should do its own due diligence.
Beyond that, aren't all valuations opinion, and that it was only the facts on the property, the building size, the lot size...etc, that are subject to fraud claims?

Valuation is an art and a science. False statements on a loan application can be about anything. One thing they pointed to was that Trump had different square footage on the same property but different loan applications.

Valuations may be an art and a science, but in the end it is stil an opinion.
Only the free market, at the time of the deal can determine the real valuation. For example you can value your house high when you want to sell it, but it's only the final agreement between the buyer and the seller, or in this case, the borrower and the lender, that gives you a real valuation, at that point in time.
Free markets determine real valuations, not judges and not laws.

That's something that could potentially be fraudulent since it's a factual misrepresentation. But still you would need to prove a person's intentions.

I agree with you, but if you knowing lie about anything you put on most loan applications, you’re committing a felony in states like New York.

I agree with you on all points. The judge has no business coming up with a value for any asset or liability. That said, the case is not about the value per se. It’s about Trump lying on the loan application which is a felony in NY.

Stating you think your property is worth more than the bank is not a felony, I’ve taken out many loans on properties in NY - I state what I think the property is worth and the bank does an appraisal to determine what they think it’s worth.
And you can disagree with the bank’s appraisal and negotiate it with them.

The difference, that you appear to be missing, no matter what I say, is lying on an application is a felony.
Read any loan app, most say that upon signing, you’re certifying under penalty of perjury that the info is true and correct.
the prosecution is saying Trump lied. The hard part is proving he lied. Like you he will say, this is what I think that asset is worth...actually, Trump is saying he relied on his accountants so he has an even better argument.
Stating the value that you believe your property is worth is not lying.

Value is an arbitrary number anyway, any property is only worth what someone is willing to pay for it when you actually sell it.
