In a properly functioning legal system, this judge would be stopped or removed by a prerogative writ such as mandamus or prohibition. It is a waste of judicial resources for it to continue. “Judicial economy” requires that it end. Everyday it continues is another day that a serious criminal case is delayed. There is a clear political agenda from the judge and prosecutor.

Trump has his valuation and while the numbers might be outrageous, they cant prove he had intent to defraud. The fact that he paid off many of these loans proves otherwise.

Didn't Trump also have a “disclaimer clause” about his valuation?

It said something about the valuation may be wrong and that the bank should do its own due diligence.

Beyond that, aren't all valuations opinion, and that it was only the facts on the property, the building size, the lot size...etc, that are subject to fraud claims?

Unfortunately, the legal system is owned and operated by the left.
Perpetuating its drain on our resources is their mission and lifeblood.
Same as public education, “More money for education” has been their battle cry for a century.
It’s not a waste of resources, it’s their ever-expanding grip on the institution.

Valuation is an art and a science. False statements on a loan application can be about anything. One thing they pointed to was that Trump had different square footage on the same property but different loan applications.

Valuations may be an art and a science, but in the end it is stil an opinion.

Only the free market, at the time of the deal can determine the real valuation. For example you can value your house high when you want to sell it, but it's only the final agreement between the buyer and the seller, or in this case, the borrower and the lender, that gives you a real valuation, at that point in time.

Free markets determine real valuations, not judges and not laws.

One thing they pointed to was that Trump had different square footage...

That's something that could potentially be fraudulent since it's a factual misrepresentation. But still you would need to prove a person's intentions.

You can put any value you want on a loan application, the bank ultimately decides what they will lend you

I agree with you, but if you knowing lie about anything you put on most loan applications, you’re committing a felony in states like New York.

That is what the case is about.

I agree with you on all points. The judge has no business coming up with a value for any asset or liability. That said, the case is not about the value per se. It’s about Trump lying on the loan application which is a felony in NY.

Stating you think your property is worth more than the bank is not a felony, I’ve taken out many loans on properties in NY - I state what I think the property is worth and the bank does an appraisal to determine what they think it’s worth.

And you can disagree with the bank’s appraisal and negotiate it with them.

Seems like we are talking past each other. I agree with everything you’re saying.

The difference, that you appear to be missing, no matter what I say, is lying on an application is a felony.

Read any loan app, most say that upon signing, you’re certifying under penalty of perjury that the info is true and correct.

the prosecution is saying Trump lied. The hard part is proving he lied. Like you he will say, this is what I think that asset is worth...actually, Trump is saying he relied on his accountants so he has an even better argument.

Stating the value that you believe your property is worth is not lying.
That’s why bank do their own appraisals.

Value is an arbitrary number anyway, any property is only worth what someone is willing to pay for it when you actually sell it.
