Seattle judge blocks Trump immigration order

SEATTLE/BOSTON - A federal judge in Seattle on Friday granted a nationwide temporary restraining order blocking U.S. President Donald Trump's recent action barring nationals from seven countries from entering the United States.

The judge's order represents a major challenge to the Trump administration, which is expected to immediately appeal. The judge declined to stay the order, suggesting that travel restrictions could be lifted immediately.

The challenge was brought by the state of Washington and later joined by the state of Minnesota. The Seattle judge ruled that the states have legal standing to sue, which could help Democratic attorneys general take on Trump in court on issues beyond immigration.

"It's a wonderful day for the rule of law in this country," said Washington state solicitor general Noah Purcell.

The decision came on a day that attorneys from four states were in courts challenging Trump's executive order. Trump's administration justified the action on national security grounds, but opponents labeled it an unconstitutional order targeting people based on religious beliefs.

Earlier on Friday, a federal judge in Boston on Friday declined to extend a temporary restraining order that allowed some immigrants into the United States from certain countries despite being barred by U.S. President Donald Trump's recent executive order.

Also on Friday in Virginia, a federal judge ordered the White House to provide a list of all people stopped from entering the United States by the travel ban.

The State Department said on Friday that fewer than 60,000 visas previously issued to citizens of Iran, Iraq, Libya, Somalia, Sudan, Syria and Yemen had been invalidated as a result of the order. That disclosure followed media reports that government lawyers were citing a figure of 100,000.

Rudy in a previous interview had said that he told Trump you couldn’t ban people based on religion, and Rudy didn’t support that. However, he said you could restrict on areas of terror. I believe Trump stopped talking about a Muslim ban prior to the convention (correct me if I’m wrong).

Trump should then instruct border security that all immigrants must have a few more documents in hand before they are allowed in. Maybe request stamped original birth certificates, copies of their school grades, 50 letters of reference. He is not technically enforcing the ban, just requiring a little more paperwork. Make it much more difficult to enter.
That will give him time until this stupid ruling gets overturned. Drown the applicants with requested paperwork. That will slow them down.

The Left will keep filing these until they get a judge who has his head firmly implanted.

The other case died this morning.

Why can the Left keep filing these over and over and over again? Do these judges have authority or not?

Once it’s reviewed, it should be over.

SC is 4-4 at best so a lower court stands. If they appeal you are accepting the court had standing no? It seems to me Trump should just ignore and have DHS carry out his EO. Otherwise the left will just keep finding friendly judges.

Exactly. If we don’t have an executive subject to the rule of law, we don’t have anything. I used to tell lefties that if you would be worried about a republican president having this power, you don’t want obama to have it. Now, I tell people that if you didn’t want Obama having this power, you shouldn’t give it to Trump. A vision of the executive power that relies on only the good guys ever taking office is a recipe for disaster.

These are temporary stays, and courts are mostly encouraged to issue them because there is so much uncertainty about what is going on. As the administration clarifies exactly what’s going on and people aren’t left in limbo in airports, the rationale for a stay dissipates.

Much better to let the legal process work (and keep appointing judges) than to declare the executive branch only has to obey the judicial branch when it feels like it.

No “explaining” by the Whitehouse will stop these injunctions.

So that reality means this thread is about something that has not happened and isn’t even fake news.

Probably because they don’t have a leg to stand on. It’s not an immigration ban. It’s a temporary pause in issuing new visas to make sure the procedures are adequate and standardized.

It names countries known to support terrorists, and where there isn’t much information available for the vetting process. It implements the required face to face interview that Obama had waived.

It names no religion. It states that preference should be given to people that are subject to persecution. That’s not just Christians, that is also minority sects of Islam.

It provides that applicants must support the constitution and harbor no bigotry against gays, women, ethnicity, and do not support honor killings.

Maybe this is probably an attempt to keep legal occupied to slow down the investigations of treason and other illegal activities.

No it only extends to our borders, it does not let them get here, And it is mostly negated since State revoked/canceled Visas already.

Impeachment should be what this judge gets, but unfortunately, the 2/3 threshold in the Senate makes that impossible. The only solution to facing 8 years of obstruction is to take away the jurisdiction from these courts for anything but slip and falls. Congress can add judges to the 9th circuit, and it can create a special court for constitutional challenges and it can do many things to sidestep these judicial activists, if only the RINOs had any guts. It just takes a majority. It’s the only way.

Exactly. Trump should ignore the ruling and state these actions are pursuant to Congressional authorization.

The Authorization for Use of Military Force (AUMF), Pub. L. 107-40, codified at 115 Stat. 224 and passed as S.J.Res. 23 by the United States Congress on September 14, 2001, authorizes the use of United States Armed Forces against those responsible for the attacks on September 11, 2001 and any “associated forces”. The authorization granted the President the authority to use all “necessary and appropriate force” against those whom he determined “planned, authorized, committed or aided” the September 11th attacks, or who harbored said persons or groups.

The AUMF was signed by President George W. Bush on September 18, 2001. As of December 2016, the Office of the President published a brief interpreting the AUMF as providing Congressional authorization for the use of force against ISIS and other Islamic militant groups.

All Trump is doing is conducting operations to interdict the inflow of ISIS and other Islamic militant groups into the US. The force he’s using with the immigration action is simply “non-lethal” force.
