With Trump asking the Supreme Court to uphold his travel ban, I know for certain that if the case is heard before Anthony Kennedy retires, the decision will be in his hands. Needless to say I am very doubtful that we I can count on Kennedy to uphold it.
That made me think - how would the 21st century be different had Robert Bork been nominated to the Supreme Court instead of Kennedy? Its obvious that SSM never would have been legalized via the court, and Roe vs. Wade would've stood a good chance of being overturned. What other decisions do you think would have been different?
Bork has been dead for over 3 years.
Bork couldn’t find the RKBA in the 2nd Amendment.
Ted Kennedy, the swimmer, got off. No fight in the GOP.
Well the fact that he’s dead might cause a problem.
What if Judge Roberts was swept up in a tornado while mowing his lawn? I don’t know.
I’ve heard the same. Not sure he would have been all that great on other issues, given that he missed the clear and obvious intent of the Second Amendment.
I dunno. Can anyone prove to me that Ruth Ginsberg is still alive?
REpublican presidents without a doubt have picked the worse people. I wouldn’t go with the Bork analogy.
I go with the picks themselves.
Look at them.
John Paul Stevens by Gerald Ford
Sandra Day O’Conner by Reagan
Kennedy by Reagan
John Roberts by Bush
Wasn’t Souter a GOP pick too?
The Dems pick ideologues, the Republicans pick compromises. It really isn’t much more complicated than that. Although, I will say that Gorsuch may have broken that mold. Time will tell.
I’ve often thought that Ted Kennedy did one good thing while seated in the Senate.
WEEKEND AT BERNIES on the Supreme Court.
Yes, by George Bush
That's a static assessment. The question would be would he have died when he did if he had been confirmed to serve?
A lot of variables would have played into his health.
Bork hated the Second Amendment. Glad he didn’t make it.
Rehnquist was appointed as an associate judge then became chief justice when Burger stepped down. How can that happen? Is it the president’s decision who he replaces?
They were playing hard-to-get for several years on this issue, if you remember.
Unlike many SC justices, Bork was moving steadily right, so it’s not a sure thing that he would be against the RKBA during his tenure. After all, he was pro-abort at one time as well.
I’ve found that political ideology is fairly self-affirming and monolithic, otherwise it conflicts with itself. You can’t find a staunchly pro-life person who isn’t also pro-2nd.
