Florida city commissioner charged with second degree murder in fatal shooting of shoplifter

The Oct. 3 shooting was captured on store surveillance and showed Lakeland City Commissioner Michael Dunn firing at Christobal Lopez, 50, at the front door of Dunn's Vets Army & Navy Surplus.

Dunn could be seen grabbing Lopez, an agricultural laborer, as he tried to leave, then firing a semiautomatic Glock at him. Lopez was holding a hatchet in his right hand that belonged to the store, police said, but wasn't seen in the video physically threatening Dunn.

This is Lakeland, a conservative hotbed and home of Grady Judd, a famously tough sheriff. Therefore I predict the commissioner will be acquitted.

The problem is he shot this guy as he was trying to get away and not posing a threat to the shop keeper. This is going to be tough to defend in court.

Well, just going by the video, the perp thief was trying to get away and was outside when he was shot trying to escape. The shooter was not in any danger at the time so yeah; at least manslaughter of some kind. Can’t just shoot someone if your life or some one else is not in danger even with stand your ground laws.

This thief paid the ultimate price for his crime but would have probably been ROR’d by the court or picked up by ICE if illegal.

The lesson also is don’t shoot someone unless you fear for the safety of someone.

I watched the video.

Looks like a good use of force but you never know what the jury and the DA will do.

You don't have to let someone bury a hatchet in your head before you shoot them.

In Texas you can use deadly force to stop a thief from fleeing with your stolen property. Personally I would not unless he was a mortal threat
