On August 6, 2023 Carolin Glick wrote in Arutz 7 " On Sept. 15, just two weeks before she heads for the exit, Hayut will take the unprecedented step of convening the entire court—all 15 justices—to adjudicate an even more outrageous petition regarding a Basic Law. That day, Hayut and her associate justices will hear arguments regarding a petition asking them to overturn the Knesset’s amendment to the Basic Law: Judiciary from last month. That amendment bars the justices from abrogating lawful decisions by the government, prime minister and government ministers on the grounds of “reasonableness.”

"In other words, it limits the court’s power to set government policy based on the judges’ “special spice.” Not only do the justices lack the legal authority to adjudicate this petition, they are in an open conflict of interest because the law relates to their own power. But that is the whole point. By adjudicating the Edelstein and Incapacitation Clause petitions, Hayut canceled the powers of Israel’s democratically elected institutions and seized them for the court. On Sept. 15, Hayut intends to end her judicial career by asserting that there can be no limits of any sort placed on the court’s powers.

"As a short-term player, Hayut sees the game ending on Sept. 30. But, of course, on Oct. 1, Israel will be left to contend with the consequences of her actions. And those will be a disaster. Indeed, they already are. Halutz’s moves put Israel on the fast track to Halutz’s civil war.

"Bell notes, “A parliament asserts its authority by passing laws. By annulling the Knesset’s power to enact laws, the court is destroying the last vestiges of Israel’s democratic institutions. How are democratic institutions supposed to assert their authority if it isn’t by passing laws? All that’s left is confrontation, by actually rejecting the authority of the court.”

A Jewish Kingdom in Judea and Samaria would be also in the best interest of Israel since it would prevent Hamas to take over and attack Israel with missiles as it does from Gaza.

On September 1, 2022 Arutz 7 reported "In the heart of Samaria, near the Karnei Shomron industrial zone, massive development works are underway within Areas C on both state and privately owned Jewish land, including development of lots, construction of buildings, breaking and paving of new roads, and setting up connections to infrastructure.

"Work began around six months ago, at which point the Regavim organization contacted the relevant authorities in the hope that they would enforce the law. When no response was received and construction work continued, Regavim submitted a petition to the courts.

"The petition details the extensive scope of construction work near the Karnei Shomron industrial zone and the village of Lekef that is being carried out illegally, without permits, on state lands and also on private land including tracts belonging to the "Har Veguy" company owned by the Zer family. Over the past few months, Regavim has repeatedly appealed to the authorities with the demand that they cease the work, with an emphasis on the privately owned area, but responses have been few and inadequate despite the significance - and meanwhile, construction continues apace.

"Binyamin Council head in US to meet with members of Congress Regavim points out that in similar cases such as Amona, Migron, and Netiv Ha'avot, the courts have not hesitated to rule against construction taking place on privately owned land, and have made the issues a priority for the authorities to address.

"The Palestinian Authority is taking advantage of the ineptness of the authorities and is in effect promoting a strategic plan for the establishment of a Palestinian state in Area C," said Moshe Shmueli, Regavim's coordinator of Judea and Samaria.

"Before our very eyes we see how day by day, illegal construction is taking over huge areas of state land and private land of Jews. Only recently we documented another new building and planting of trees. We're not talking about a lone house - what we're seeing is the construction of infrastructure including roads, water, and electricity. Meanwhile, the authorities are doing nothing and the Jewish landowners are left to stand helplessly by.

"The situation is simply outrageous." The head of the Samaria Regional Council, Yossi Dagan, added, "The government is systematically abandoning Area C and now also private lands that were purchased by Jews. If this were about private lands belonging to Arabs, everyone would be up in arms. Selective enforcement is reaching a peak we have never seen before. We demand that the relevant authorities and the government immediately put a stop to the construction and takeover of Area C, on both private and state lands, assets belonging to the State of Israel and the Jewish people."

The article says "The Palestinian Authority is taking advantage of the ineptness of the authorities..." but the Israeli authories are not inept, they are complicit. They are giving away Area C because they want that land to become part of a Palestinian State. Israeli authorities are not only failing to apply sovereignty they are actually surrendering the land.

The Israeli government is surrendering Area C and Netanyahu will not change this as exolained in my previous article linked below.

The previous time he was PM Netanyahu not only failed to apply sovereignty but was also surrendering parts of Area C to the Arabs, was this because of the Supreme Court?

There is no true democracy in Israel, there is a tyranny of the Supreme Court. The government is complicit with it and Netanyahu did nothing (or could do nothing) to confront it or weaken it while he was PM before and is not being able to change this now.

Orthodox Jews living in Jerusalem and Area C do not want to be ruled anymore by Tel Aviv's secular left wing activists that control the Supreme Court.

Since the secular/religious divide is so deep why not separate religious Jerusalem and Area C from secular Tel Aviv? The left does not want this land anyway and is giving it away.

The majority of Jerusalem's population was Jewish until 1948 when the Jordanian Arab Legion expelled all the Jews and destroyed all the synagogues in the Old City.

There should be a referendum asking whether residents of Jerusalem and Area C would prefer independence from Israel's supreme court tyranny by declaring a new independent nation: The Jewish Kingdom of Judah .

Israel's left controls the supreme court and wants to withdraw from Eastern Jerusalem and Area C. Again and again we see left wing organizations such as Betselem, Peace Now, JStreet, Ifnotnow calling to "end the occupation". Obama's 2016 UNSC 2334 calls Judea, Samaria, Eastern Jerusalem (including the Old City, Temple Mount, the Western Wall) "occupied Palestinian Territories". To comply with UNSC 2334 and avoid the criminalization of Israel and its government officials, the Israeli Government is currently surrendering parts of Area C and may decide to withdraw from Jerusalem's Old City.

Why should left wing Jews who hate religion have the power to decide whether religious Jews have the right to live in the heart of the Jewish homeland where the ancient Kingdom of Judah used to be? The Kingdom of Judah must be recreated in Jerusalem and Area C and separate from Israel once again.

Jews were not allowed to pray in the Western Wall during Jordanian rule and will not be given access if the old city is surrendered.

Since the left does not want Eastern Jerusalem and Area C anyway, Orthodox Jews from Jerusalem and Area C must take their fate in their own hands and declare independence from Israel through a referendum.

Since the left wants to withdraw from Area C, there should be a referendum to give the residents of Area C the right to create a new State with an independent Judean army. The right of self determination of the residents of Area C must be respected.

The right of self determination was used for example by the British Government in the conflict with Argentina for the Falkland Islands.

The British Government website explains "The people of the Falklands are British and have chosen to be so. They have the right to self-determination as set out in the UN Charter...the UK government remains committed to promoting the rights of the Falkland Islanders and defending the islands...There will be no negotiations on the sovereignty of the Falkland Islands unless and until the islanders decide. The UK regrets the policy of the current Argentine government and remains keen to work with the Argentine government on areas of mutual interest in the South Atlantic (eg fisheries conservation), and promote better co-operation between Argentina and the Falkland Islands. On 10-11 March 2013 the Falkland Islands Government held a referendum on whether or not to maintain the Islands’ status as a British Overseas Territory. There were 1513 votes (99.8%) in favour and three against. The turnout was 92% of an electorate of 1653. As the Prime Minister and Foreign Secretary said on 12 March, the Government hopes that Argentina and other countries respect the referendum result and the Islanders’ expressed wishes, which were demonstrated beyond all doubt. The UK will remain committed to the Falkland Islanders and defend their rights to determine how they are governed, which is enshrined in the UN Charter."

Not only the Falkland Islands had a referendum, there was one in Brazil also.

On March 29, 1993 the New York Times reported that there was a referendum to turn Brazil into a Monarchy "...Cut short after 67 years by an army coup in 1889, the New World's only successful monarchy may be on the road to restoration. Republic or Kingdom? On April 21, after a century long ban on monarchist politics, Brazilians are to vote in a national plebiscite to decide whether Latin America's largest country should continue as a republic or should revert to an ancient title, the Kingdom of Brazil. The 1988 Constitution provided for a plebiscite this year to allow Brazilians to choose what system of Government they want..."

If the Brazilians had a national plebiscite to choose what system of government they wanted why can't Israel? There are several Islamic Monarchies among the 57 members of the Organization for Islamic Cooperation, why can't there be a Jewish Monarchy?

Quebeq had a referendum to separate from Canada, Catalunia had a referendum to separate from Spain, Jerusalem and Area C should have a referendum to separate from Israel.

The Muslims have Mecca and Medina as their holiest cities ruled by the King of Saudi Arabia who is also their religious leader. Catholics have Vatican City, ruled by the Pope. There should be a referendum asking the inhabitants of Jerusalem and Area C whether they want to secede from Israel and become an independent country, the Jewish Kingdom of Judah.

Most inhabitants of Jerusalem and Area C are religious orthodox Jews and their self determination must be respected.

Since the Arabs have a Kingdom created from British Mandate Palestine land in Jordan, a Jewish Kingdom should be created in Area C.

Palestine and Jordan are one…” said King Abdullah in 1948.

“The truth is that Jordan is Palestine and Palestine is Jordan,”said King Hussein of Jordan, in 1981.

Jordan was created with land from British Mandate Palestine, 78% of the Jordanian population is Palestinian.

The Queen of Jordan is Palestinian, Jordan's next King will be the son of a Palestinian.

The left is surrendering Area C because they prefer a Palestinian State rather than a Jewish Kingdom there. Sooner or later the religious right will realize that secession is the only way to prevent the left from surrendering Area C.

Israel is not a democracy, it is a judicial tyranny. Religious Jews deserve a State of their own where their vote counts and they are not treated as second class citizens by the unelected anti-religious elites. A "Three State Solution" is needed: The Jewish Kingdom of Judea for religious Jews, the Socialist Undemocratic Judiciary Tyranny of Israel for secular Israelis, the Islamic Kingdom of Jordan for Palestinian Arabs.

The kingdoms of Israel, Judah and Judea didn’t have a very good track record. They had a few good kings, but most of their kings were bad.

There is only one way to finish killing off the Jews and that is to incite them from within into committing suicide. We are witnessing the same self-destructive behavior as the Jews exhibited when a substantial proportion of them sided with their enemies in Hasmonean and again in Roman times. If a people won’t even unite in defense of their survival and rightful homeland, they won’t last.
Also, and this applies to Israel giving away so much land and paying off the Fakestinian PLO murder gangsters as well as to USA paying off the hostile Iranian dictators -— appeasement does not work. As any study of history demonstrates clearly. Rome tried paying off the enemies on her borders too. The “barbarians” will take your money for awhile and then, yes, they will attack you nevertheless.

Israel’s Supreme Court has become a sort of supreme senate with executive powers. Our own SC had crossed that line too, voting based not on constitutional law, but rather based on whether or not they approved politically.

The constitutionalists have regained control temporarily thanks to Trump’s judges, but among Democrats the concept of SC limiting itself to its constitutional duty went out long ago.

The notion of an unelected supreme court telling an elected legislature that it cannot limit the power of the court means the nation is not a democracy or republic, it’s a Judicial Tyranny. It should not be allowed to exist.
