Naydich was placed on an unpaid leave of absence shortly after returning to work in August

I think because of past federal education regulations, etc. they couldn’t institutionalize him. The law requires that he have the same educational opportunities as other normal students.

The problem is in Liberal LaLaland (and no land is more LaLaland then the professional education establishment!) reality is not even optional its ignored!

The violent hulking teen had three prior battery arrests before the attack on Naydich.

Depa’s attorneys have highlighted his mental deficits and argued he wasn’t competent to stand trial.

Now 18, the 6’6” Depa was initially charged as a juvenile.

There is the problem. We do not have enough Mental Health facilities to treat these people and to protect society. Thank the Federal Court System for that.

This is the same rag (the Daily Mail) with the headline a few weeks ago stating that the teacher “refused” to suggest that the kid serve less time. They sure had no sympathy for her and her injuries at that time.

There should be no hate crime laws nor should there be any deviance of punishment based on mental state or level. Unless in the most extreme cases where a person literally doesn’t know what they are doing.

Treat everyone the same by the law based on their crime period.

If someone is even remotely aware of their actions they should take the full punishment.

This slippery slope of weighing punishment by IQ level, age (beyond say 12 of age) , gender, social disfranchisement, equity, CRT, thoughts of hate will just continue leading to higher levels of violence.

IMHO it’s time to get tough on crime again.

Probably because he’s autistic. If they still had long term nervous hospitals I for one would be in favor of him doing 30 years there. They would be better equipped than a prison than dealing with autism.

Answer:
It’s because it will require actual institutionalization that means bad political optics! The effort will challenged “ad nauseum” by Dickensian images and stories of institutional abuses & cruelties. Legions of psychiatrists, psychologists, social workers & “crying mothers” will be paraded through both federal & state legislative committees saying how awful and unsupportive to treatment it is! Few politicians could withstand that PR onslaught.

Everyone deserves a chance at a normal life.
This guy’s chance expired with the first assault he committed. No way he should have been in the general population or school setting.
His rights ended when he began attacking the rights of the teacher. Hang him.
