A summary of some of the key persons involved in the Air-A scandals, and their friends, August 19, 2005

Some of you out there probably have located most of this information before. The following is based on a series of emails I sent to Michelle Malkin and Radio Equalizer over the last few days. I am sure others have sent them similar items, as well as posting them at FR. [My comments are in brackets; some key names, dates, places, organizations and links are highlighted in bold letters]

[Michelle Malkin and Radio Equalizer (Brian Maloney) summarized in Michelle's blog of August 17, 2005 the following with regard to key figures in what I refer to as AirA-gate; dubbed Air-Enron by Michelle Malkin.]

Five months later, on Nov. 24, 2004, Judge Diamond filed a default judgment ordering Air America to pay Multicultural Radio the sum of $255,518.86 in damages.
Six months after that order was filed, Multicultural Radio still had not been paid. On May 24, 2005, the company filed another complaint with the New York State Supreme Court--this time with legal guns blazing. Named as defendants were past officers and directors of Air America Radio, as well as current officers, directors and investors of Piquant LLC, including:

"As a venture capitalist and fund manager I have had the experience to recognize a good value stock when I see it. Sinclair Broadcasting Group (NADAQ: SBGI) has had a bad year as is evidenced by the following chart:

As the co-founder of Air America Radio (AAR), I have learned a lot about broadcast media and the decline in markets and advertising caused by management that
does not have a vision for growing markets. One of the major issues we had when we started AAR was the lack of available radio stations that understood that the best and most loyal audience for advertisers is educated progressive people. These people used to be called YUPPIES, but there is a growing trend in America that TV and radio broadcasters are missing. This educated and mostly secular audience buy a lot of stuff we call adult toys. They are the best audiences for advertisers.

Managing a public company creates an enormous fiduciary responsibility. Under the recent Sarbanes/Oxley legislation to fight corporate corruption and cronyism, the CEO of a public company has a much greater responsibility for the proper stewardship of the company. In this case, it is clear that David Smith, the CEO has done a terrible job of producing revenue for the TV stations owned by Sinclair. And due to the Communications Act of 1996, the asset value of radio and TV has soared dramatically. Therefore, David Smith should be held responsible for the poor performance of the company stock because of his lack of objectivity in utilizing his TV licenses to provide the most revenue and market value for his shareholders.

In my opinion, the company will be forced to change its programming or sell it’s valuable TV licenses to another company if Mr. Smith does not get his act together. He has a lot of institutional investors that probably have
lost lots of value because of his bad programming decisions. Here is a list of those institutional investors:

Sheldon and Anita Drobny spoke to the Illinois Tenth Congressional District Democrats and guests from around the state. The room was packed, standing room only. The Drobnys talked about the birth of Air America Radio and a new project to purchase radio stations in smaller markets. The company they are creating is called Nova M Radio and capitalizes on the truth established by the Drobnys that there is a strong market for liberal radio.

COFFEY, Circuit Judge. The petitioners-appellants, Sheldon and Anita Drobny are husband and wife. During the late 1970's, Sheldon Drobny, a former IRS agent, was a partner in the accounting firm of Adler & Drobny, Ltd., based near Chicago, Illinois. Drobny promoted (and he and his wife invested in) two "research and development" programs purportedly designed to develop the substance known as "aloe vera" for commercial purposes. "Aloe vera" is an extract of the Aloe Barbadensis plant, and today is used in many skin-care and personal hygiene products. The Drobnys, on their joint federal income tax return for 1979 (prepared by Sheldon Drobny), claimed certain losses as deductions in connection with their investment in the aloe vera research and development programs. In 1983, the Illinois District Director of the IRS (based in Chicago, Illinois) disallowed these deductions, after determining through investigation that they were part of an impermissible "tax shelter" scheme, and informed the Drobnys that they were liable for a $10,877 tax deficiency. The District Director also notified Sheldon Drobny that he was liable for a civil fraud penalty (or "addition to tax") in the amount of $5,439. The Drobnys petitioned the Tax Court for a re-determination of the deficiency and the addition to tax. Following a trial, the United States Tax Court ruled in favor of the Commissioner. Drobny v. C.I.R., 86 T.C. 1326 (1986) ("Drobny I"). The Drobnys failed to file a timely notice of appeal 1 or a timely motion to vacate or revise the decision, which became final on September 24, 1986 (90 days after the decision was entered). Fed.R. App.P. 13(a); 26 U.S.C. sec. 7481(a)(1). In February of 1994, more than seven years after the decision became final, the Drobnys filed a motion to vacate the 1986 decision in Drobny I, arguing that the Tax Court should set aside its previous decision because the Commissioner, through his agents and attorneys, 2 had allegedly engaged in conduct that amounted to a "fraud upon the court." After a lengthy hearing, the Tax Court found that the petitioners had fallen short of demonstrating a "fraud upon the court" that would warrant vacating an otherwise final decision and denied the motion on May 17, 1995. Drobny v. C.I.R., 69 T.C.M. (CCH) 2600 ("Drobny II"). We affirm.

Who is Sheldon Drobny?

Started her music career at the age of six. She studied with Rudolph Ganz at the Chicago Music Conservatory. She has invested in many theatrical productions in the Chicagoland area, as well as the 20th anniversary revival of Annie, which appeared on Broadway. Chairman and Principal of the Paradigm Group - has been the major force in developing Paradigm to the status it has achieved today. Paradigm is an investment firm with offices in Chicago and Cleveland. Paradigm has provided over $200 million in capital for over 40 companies since 1995. Paradigm has also invested in Chicago theatrical productions as well as the 20th anniversary revival of Annie which appeared on Broadway. Liberals Must Work Together and Fix What’s Broken

That is why Anita Drobny started the 4th Estate Society this year. Its purpose is to get investigative reporting back to the days when Woodward and Bernstein were able to break the Watergate scandal. In today's corporate climate, that could never happen.

The 4th Estate Society is a 501(c)(3) organization and accordingly is nonpartisan. An informed public is important to the well being of this country no matter which party benefits from it. We desperately need an independent press to protect us from the natural tendency for those in power to try to suppress negative information about them. It is very human for those in power to show their best face to the public, but that is not in the public's best interest. As I did before we started Air America , I would be happy to follow anyone who has the funds and commitment to do the same work as planned by the 4th Estate Society and join forces with them. I hope such organizations are out there willing to unite for the common cause to get enough support to make a difference in the next election.

The Need

Commercial and political pressures on U.S. media have led to a decline in hard-hitting journalism capable of
shining a bright light on those in power.

With so much at stake, the
Fourth Estate Society (FES) seeks to revitalize the tradition of independent journalism in the United States. Its goal is to uncover important news and present it to the American people in a lively way to spur informed citizen action.

The project will start by enlisting
top journalists with reliable records of uncovering stories that have shaped recent history but who are now frustrated by constraints imposed by the major news media.

The Plan

The Fourth Estate Society is a
nonprofit 501(c)(3) corporation that will serve as an umbrella organization for projects advancing the cause of independent journalism and will make that information available to large numbers of Americans.

Broader Goals

The broader goal of FES projects will be to bring more context to daily news and to fill in gaps of knowledge resulting from government secrecy and a dangerous lack of accountability across large swaths of the U.S. government. The secrecy of the military-industrial complex, for example, has given rise to an economy of
“crony capitalism” that has put billions of taxpayer dollars in the coffers of well-connected companies, robbing U.S. citizens of much-needed resources.

Instead of reporting the
hard truths about issues of war and peace, for instance, these networks wrapped themselves in the American flagbranding themselves as patriotic, thereby boosting short-term ratings and appeasing advertisers.

In this
environment of fear and flag-waving, challenging investigative journalism has all but disappeared.

First Steps

FES founder is Anita Drobny, who founded the talk-radio network Air America Radio and has a background in accounting and venture capital. The
experience of building the radio network gave Drobny insight into the current media crisis and prompted her to find ways to address it. Based in a suburb of Chicago, Drobny is an executive at the Paradigm Group investment firm.

That's some heavy reading. Takes some time to sort through.

One thing that is still really disturbing is how the Clintons used the White House to enrich themselves. Somehow I doubt President Bush is shaking down rich donors for personal enrichment. The priorities of the Clintons are very clear. Power and money, although they probably see the two as the same.

I did searched for a Visual Map of Fenton Communications and was amazed! Clicking on the George Soro connection and then on the MOVE-ON connection is an eye opening experience.

But I do think it all spells one thing...

Air America is on the way out...

But then again, could that be a bad thing???

I sure do like it when they have a national forum like this, where they "clearly" illustrate why our mere discussion about their biased and rediculous format help us know where the pulse of main-stream liberalism and socialism are at any particular time...

Sure, I do not listen to it, but I know already what their take is going to be on any particular topic they choose to latch on at any given time...

So in a sense, they are a known quantity, without having to really do a lot of research and study to verify that fact...

Good work folks...Thats what its all about...

Thanks for the research here. . .impressive and 'dogged'; I hope some of this 'black and white' forces some of the media to do precisely what the Drobney's claim to want. . .ie "real investigative reporting'.

Who is Air America is a worthwhile question.

I note that unlike conservative radio, which has been individualistic and fairly spontaneous, Air America owes its existence to a planned top down effort. It's what you'd expect from leftists, whose general philosophy argues that our lives be handled the same way, directed and centrally planned, from the top down.

Instead of reporting the hard truths about issues of war and peace, for instance, these networks wrapped themselves in the American flag—branding themselves as patriotic, thereby boosting short-term ratings and appeasing advertisers.

The problem begins in their 'schizophrenic mind's eye'. . .they will forever delude themselves.

Good point and so true; revealed so readily; as per their own arrogance they assign to the 'others' that do not share their altar.

One thing that I can't get over is the fact that the world's wealthiest business folk are leftists. I can't help but think that's because they are attracted to the raw power that progressivism offers. The top down aspect of it. In fact, the more I mull that over, the more obvious it suddenly seems.

They must be attracted to the fantastic idea that their intellects, which amassed such great wealth, could also be used to order and arrange a just and beautiful society.

The wealthy Hollywood types though, IMO, are just airheads, many of them, tricked by the fake compassion, do goodism and egalitarianism of the Left. Same goes for the everyday "liberal."

Yes. . .that is an interesting correlation. . .progressivism/raw power. . .and a line that surely deserves expansion. It does explain the mutual attraction of coarseness of the two. . .and an interesting turn/facet of what was/is, there all the time. . .another aspect of the 'God complex' that these people share. . .

A complex which allows an unbridaled arrogance - and hypocrisy couched in a compassion which is no more than their self-serving, 'will to power'. . .they share a 'self-ordained' vision - and one, superior to it's alternative, of course.

These 'ultra-progressives' ARE meglomanics. . .of the first order. . .and their schizo version of reality is why it is impossible to reason with them. . .

In their 'God-mind' they believe they can create a 'heaven-on-earth'; or recreate a 'Garden of Eden'. . .but whatever; their heaven. . .is where they are the 'gods' in control; where they make the rules for the rest of us; on what to eat in their kingdom. . .

These people cannot be saved from themselves; the challenge we face, is saving ourselves from them.
