Not A Killer But Still Facing A Date With The Executioner (MSM Template Of The Day Alert)
New York Times ^ | 08/30/2007 | Ralph Blumenthal

Posted on 08/30/2007 6:40:17 AM PDT by goldstategop

Ensnared in a Texas law that makes accomplices subject to the death penalty, Mr. Foster, 30, is to become the third death row inmate this week, and the 403rd since capital punishment resumed in Texas in 1982, to give his life for a life taken.

But unlike most others condemned to death in this state, Mr. Foster, a former gang member and aspiring musician and now a prison poet from San Antonio, is not a murderer in the usual sense. He was convicted and sentenced to die for abetting a killing — 80 feet away — that he might, or might not, have had reason to anticipate.

The MSM's template this morning, beginning in the New York Times and repeated with variations in the country's major newspapers, is to assert Kenneth Foster, convicted of murder under Texas' felony murder rule... is NOT really a murderer. Now you know how the liberal media sets up a story context, regardless of the facts. The headline is the same no matter what newspaper you pick up to read. Its one giant liberal echo chamber.

If they want to campaign to make legislative changes so that accomplices will no longer to subject to the death penalty, then they can go right ahead.

But it sure looks like they want written laws ignored in favor of what the Elite consider to be a nicer outcome. That never turns out well.

If I am not mistaken, Texas is not the only state that has such a rule. For example, there have been situations where 2 thugs rob a convenience store, the clerk or store owner defends himself by killing one of the perps, and the other is convicted of murder since a murder was committed during the commission of a felony. I am sure others with a more thorough understanding of the law would be able to elaborate. In this situation, one would think that Foster’s lawyer (who should theoretically know the law) would have advised his client to cop a plea in order avoid the death penalty. The MSM will paint this thug as a martyr or an “innocent victim” of the ‘evil’ Texas death penalty.

Thought for a second the guy was wrongly convicted or something.

As it reads, though, it sounds like a good opportunity to rid the world of another piece of trash.

I believe this has always been the felony murder rule, and I believe it is the rule on the federal level as well. He might not be a murderer like "most" on death row, but he would not be the only one who is a felony murderer on death row.

To take a simple example, in Truman Capote's "In Cold Blood" (based on a real story) only the William Blake character actually kills the family members, but I believe both criminals were hanged. (If I'm inaccurate both deserved to hang).

Something told me the story the jury believed after hearing the evidence differed significantly and had Foster playing a more significant role.

It looks like if you hang out with real bad actors, you could get in trouble yourself.

Just like mom said!
.......................

The first thing I remember knowing,
Was a lonesome whistle blowing,
And a young un’s dream of growing up to ride;
On a freight train leaving town,
Not knowing where I’m bound,
No-one could change my mind but Mama tried.
One and only rebel child,
From a family, meek and mild:
My Mama seemed to know what lay in store.
Despite all my Sunday learning,
Towards the bad, I kept on turning.
‘Til Mama couldn’t hold me anymore.

And I turned twenty-one in prison doing life without parole.
No-one could steer me right but Mama tried, Mama tried.
Mama tried to raise me better, but her pleading, I denied.
That leaves only me to blame ‘cos Mama tried.

Dear old Daddy, rest his soul,
Left my Mom a heavy load;
She tried so very hard to fill his shoes.
Working hours without rest,
Wanted me to have the best.
She tried to raise me right but I refused.

And I turned twenty-one in prison doing life without parole.
No-one could steer me right but Mama tried, Mama tried.
Mama tried to raise me better, but her pleading, I denied.
That leaves only me to blame ‘cos Mama tried.

Yep, it’s called “felony murder” and it is the risk you take when you participate in a scheme that deliberately puts victims’ lives in jepoardy. Fry, string up, shoot, or stick him as just punishment and an example to others of his kind.

Yes, you should be able to participate in an armed robbery without having to worry that you might be held responsible if someone was killed in the process.

What is the NYT thinking?

The law sounds fine to me. The perp should have started running away and shouting at the top of his voice when he realized that a crime was about to be committed. Then, I could see some sympathy for him but he did nothing.

Just another NYT story where Perp = victim.

“Mr. Foster had borrowed his grandfather’s rented white Cavalier and was driving three companions — Julius Steen, Dewayne Dillard and Mauriceo Brown — on a robbery spree through San Antonio.”

““I was in jail at the time he got arrested,” said Kenneth Foster Sr., adding that a strategy of portraying his son as churchgoing and well-raised had backfired.” ....... Duhh!

Armed “Robbery spree”, “Well raised”???? Ok he’s not a felon he’s a saint. He has talent, he writes poetry, he can be a rap star, blah blah blah. If a jury convicted him and the judge gave him the death penalty , what is out there about this story that hasn’t been picked up by the NYT. They are known to make stories out of fagments. We had a similar thing here recently, this nice boy they built up in the press had 16 priors, but if you read the article he was a great kid loved by all. Another NYT story where Perp = victim.

Darn. Caught in a lie.

No wonder the NYT is outraged.

Dark and lonely on a summer’s night.
Kill my landlord. Kill my landlord.
Watchdog barking. Do he bite?
Kill my landlord. Kill my landlord.
Slip in his window. Break his neck.
Then his house I start to wreck.
Got no reason. What the heck?
Kill my landlord. Kill my landlord.
C-I-L my land lord!
