Constitutional Crisis (Vanity)

As a Briton who has lived in the United States for three years, I now find myself eligible for citizenship, which involves passing a test on the US Constitution.

Unfortunately this comes at a time when the United States is experiencing a constitutional crisis. Widespread electoral fraud has been committed by a publicly-funded socialistic anti-American outfit called ACORN. So many bogus voter registrations have now been made that the November General Election result could actually be decided by ACORN.

This is clearly an unacceptable situation - except that, apparently, you have no choice but to accept it (which is in itself unacceptable).

In 1975 there was a constitutional crisis in Australia when the two Houses of the Federal Parliament stopped cooperating with each other. The situation was resolved by the Queen's representative, Governor-General Sir John Kerr, who fired the Prime Minister, dissolved both Houses and called a Federal Election.

It seems to me that the United States needs a similar safety net. Obviously I am not suggesting you return to the Empire just yet, but you really need to amend the constitution to institute a proper electoral system to replace the current chaotic mess. How about a Convention of State Governors to fulfil the role of overseeing each General Election, with the power to cancel/overturn elections on either a national or state-by-state basis?

In the short term (i.e. before November) you should cancel all voter registrations made by ACORN.

And you should drink more tea.

And stop letting foreigners tell you what to do (especially Kenyans and Brits).

It is called a constitutional convention and the process there of is described in Article V.

The Congress, whenever two thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution, or, on the Application of the Legislatures of two thirds of the several States, shall call a Convention for proposing Amendments, which, in either Case, shall be valid to all Intents and Purposes, as part of this Constitution, when ratified by the Legislatures of three fourths of the several States, or by Conventions in three fourths thereof, as the one or the other Mode of Ratification may be proposed by the Congress; Provided that no Amendment which may be made prior to the Year One thousand eight hundred and eight shall in any Manner affect the first and fourth Clauses in the Ninth Section of the first Article; and that no State, without its Consent, shall be deprived of its equal Suffrage in the Senate.

In short, 2/3rds of the States collectively can call for a convention.

Seriously some of us, perhaps most of us, are aware of the many bendings of the Constitutional rules we live by. And there doesn’t seem to be an easy way of remedy it.

We have laws against what Acorn is doing. The problem is that almost 50% of the voters want Acorn to continue doing it and the mainstream media won’t report on it in a fair manner.

My big fear is that Obama will win in November, and that no major problems will arise until Jan 2009. At that point, he will have been inaugurated and he will officially be president.

At that time, a Kenyan birth certificate will be produced demonstrating that Barack Obama is not a naturalized citizen and therefore cannot serve as president.

What happens then? Do we ignore the Constitution? Or do we make Joe Biden president? Either way, things would not go well for our country.

I like your idea of tossing all of the ACORN-generated registrations. The examples of fraud are just too widespread and egregious to be innocent errors.

ACORN gets it's federal funding by way of that steaming pile of socialist sophistry we refer to in polite company as "The New Deal Commerce Clause". Sadly, there are people even on this site that support and defend it.

Balance of powers would prevent that here. Picture Obama with that kind of power. We may not govern ourselves as wisely as we should, but jumping out of the frying pan into the fire is not the answer.

The ability for the voters to call for some sort of “no confidence” vote that forces a congressional redistricting in a different arrangement could be interesting.

If said happens and the Supreme Court determines that while 0bama was never eligible to stand for election, they allow Biden succession, (I personally think that purposeful fraud ought not be considered the same thing as death/incapacity, that the election should be voided), while Biden is no friend to the conservative ideal, we simply cannot ignore the Constitution. It is imperative that we not allow that precedent to be set.

To my mind, if the country understands that someone tried to perpetrate a fraud in order to be elected president, they will not feel too kindly toward his running mate, will question whether or not Biden genuinely believed the lie or was just going along in order to get his post. He would not be able to forge ahead with a hard-left agenda, Congress would have to tippy-toe as well. As crummy as it sounds, a damaged Biden presidency is survivable, allowing a violation of the Constitutional requirement to hold federal office is not.

I hope some republican minded supreme court qualified attorney will take this to the supreme court and have all ACORN registrations thrown out nation wide. Whle they are at it lets have the motor voter laws overturned too. If voting is important to you then showing up at the local board of elections isn’t a hard thing to do! Heck we could even have them open until 6 pm or later in the weeks before an election so anyone would ahve no excuse as to why they couldn’;t get there to register.

You ain’t kiddin. All of the silliness about making voter registration easy-as-can-be to encourage turnout is coming back to haunt us. Want to be a voter? Go to the Board of Elections, show positive ID, and get there by the deadline.

How can we let the bottom of the ticket win the White House when the top didn’t actually win? We have to work with process like you say but I think in the event of a party being duped by foreign interests, the other party that played by the rules should win the presidency.

You raise good points. One of my worries is that, after 2000, we had endure the chant that President Bush was "selected not elected" and that it was a 5-4 vote which deprived Al Gore of the presidency.

Imagine the joy of having the first black president removed from office by the Supreme Court because his paperwork wasn't in order. There are a lot of people in our society who would find this path pretty unacceptable.

The truth of the matter is the state legislatures can appoint any electors they so choose. It’s just that we don’t have any with the guts to over ride the fraudulent election results.
