Conservative friends rise in support of Kagan

Conservative lawyers and academics are voicing support for Supreme Court nominee Elena Kagan, praise that could soften criticism from the right and provide cover for any Republican senators inclined to vote for her nomination.

The essence of their take on Kagan, the former Harvard Law School dean who now serves as solicitor general, is that she clearly has the smarts to be a justice and has shown an ability to work with all sides on thorny issues.

“She has had a remarkable and truly unusual record of reaching out across ideological divides,” said Michael McConnell, a former federal appeals court judge who was nominated by President George W. Bush.

Longtime Kagan friend Miguel Estrada, whose appeals court nomination by Bush was blocked by Senate Democrats, said, “She’s clearly qualified for the court and should be confirmed. Obviously, she’s a left-of-center academic who never would have been picked by a Republican. But no one can doubt her intellectual accomplishments.”

In a letter to the Senate Judiciary Committee Friday, Estrada said, “If such a person, who has demonstrated great intellect, high accomplishments and an upright life is not easily confirmable, I fear we will have reached a point where no capable person will readily accept a nomination for judicial service.”

Former special prosecutor Kenneth Starr, who ran the investigation that led to President Bill Clinton’s impeachment, said charges by some conservatives that Kagan holds extreme views are off-base.

“That’s politics, and unfortunately confirmation politics have been very ugly, with a few happy interludes, ever since the nomination of Judge Robert Bork,” Starr said on MSNBC.

Well, whatever chance we had of sinking this nomination became even smaller. I can only hope that she’s not as terrible as we fear.

And I'm voicing BS on this one. There is no way in heck a Conservative would support ANY type of ban on free speech, let alone a socialist dyke.

Uhhhh Miguel, pull your head out of the sand. We blew through that threshold about twenty years ago. Does the name Bork ring a bell?

Anybody else see the inherent contradiction there...'left-of-center academics' by their very nature believe in the 'Living Document' philosophy of constitutional law.

If you think the U.S. Constitution is a "living" document, then you don't believe in it--Either you accept the Constitution as it is written and properly amended, or you reject it, and subsequently you reject the country that was founded by it.

Good point. Ted Kennedy’s “In Robert Bork’s America” was a low point in the history of American judicial confirmations.

MY AGENDA: I want to know where she went to primary and high school. She has boasted about her mom being a public school teacher and bloviated about “public” service. Did she go to public schools? I know the West Side of Manhattan well. Nearly all the residents are reflexive ONETHINK liberals. And nearly all their children are sent to the pricey private schools that dot Manhattan—lest they rub shoulders with someone who is Black or Brown. Vile hypocrites! If a West Side liberal family is temporarily cash strapped, they may shamelessly use clout and political connections to place their kids in one or two selective public high schools. But this is a much less used option.

You can judge someone by their friends.

Take note of which “Conservatives” are supporting this nomination. This makes it easy to determine the frauds (RINOs).
