The fundamental legal issue is there isn't anyone that can provide testimonial evidence to prove that the address book is indeed the "D.C. Madam's Escort Service Records."

Also, if there one person in that book who never sought or partook in the illicit activity, then the book itself cannot be trusted, and publication of such would ruin an innocent life, thereby validating the concern for public good.
