Military Judge: Fines but No Jail for Deserter Bowe Bergdahl

Bowe Bergdahl will not serve more time behind bars, a military judge has decided eight years after he deserted his platoon in Afghanistan. His desertion, to which he pleaded guilty, and the subsequent search for him that led to the deaths of six soldiers did not result in the 14-year sentence prosecutors requested in the case.

The judge also ruled that Bergdahl be dishonorably discharged, that his rank be reduced from sergeant to private, and that he be required to pay a $1,000 fine from his salary for the next ten months, CNN reported.

“As everyone knows, he was a captive of the Taliban for nearly five years, and three more years have elapsed while the legal process unfolded,” Eugene Fidell, Bergdahl’s civilian attorney, said at a press conference after the sentence was handed down. “He has lost nearly a decade of his life.”

But in emotional testimony about the course of the trial, others continue to suffer as a result of Bergdahl’s decision in 2009.

I know of soldiers who did time in military confinement for AWOL statesides. This is an outrageous sentencing decision by a military judge who should know better.

I don't get it. If he's being discharged what salary are they talking about?

I would think by now we’d know name of judge, who appointed him, and voting record.

Nope ... the only change that could be made to the sentence after this point would be that the punishment could be reduced. Even should the appellate process result in the case being kicked back for retrial (for one legal reason or another), he couldn't receive a greater sentence from the retrial. The maximum that it could be is what has been adjudged, although, in the event of a retrial, he could receive a lesser sentence.

Bergdahl received an administrative discharge from the US Coast Guard in 2006 . His friends claim he was discharged for psychological reasons..why in the hell did the Army accept him? the man belongs in an institution at the very least and not released back into society. Something is very screwed up with this entire case. Obama is a disgrace for honoring this POS

His name is Colonel Jeffrey Nance and he was not appointed by anybody. He is a member of the Judge Advocate General Corps, assigned to the Trial Judiciary as a military judge.

I worked separations for years in the Marine Corps. I never saw a sentence like this.

I think the Army in some ways is admitting that they eroded in signing him up. Behaviorwise, he is a 12 year old.

This shi* isn’t over yet. The next insult to our American servicemen will be when Bergdhal signs a multi-million dollar book deal, and all those injured by his actions sue for a piece of the book deal. Of course, the courts, now dominated by eight years of Obama appointed judges, will probably come down on Bergdahl’s side and he’ll walk away a multi- millionaire.
