Virginia court tosses out one-vote victory that briefly ended GOP majority in House

A three- judge panel declined to certify the recount of a key House race today, saying that a questionable ballot should be counted in favor of the Republican and tying a race that Democrats had thought they had won by a single vote.

“The court declares there is no winner in this election,” said Circuit Court Judge Bryant L. Sugg, after the judges deliberated for more than two hours.

The court’s decision leaves the race for the 94th District tied at 11,608 votes for each Del. David Yancey, the Republican incumbent, and Shelly Simonds, his Democratic challenger.

And it leaves the balance of power in the state legislature at 49-51, in favor of Republicans - at least for now.

In the case of a tie in a House race, state law says the winner is chosen by lot – essentially, a coin toss, according to Virginia state law.

Odd decision, but valid within the law, I think.

The court decided that a ballot for the Republican was excluded that should not have been. That doesn’t mean fraud, but could simply have been misapplication of the rules - or even a judgment call the court disagreed with.

The law clearly foresaw such circumstances - given that they chose a coin flip to decide such cases.

sounds like they pulled this ballot out ...............

'd say the person filled out a second ballot and this was a throw away. We don't know WHEN it was crossed out. The ballot should be thrown out....period.

But is “questionable” automatically “invalid”? If it was questionable because the dems wanted it questions, and for no other reason...

Not enough direct data to decide, but this decision could be valid, or it could be partisan. (But not both)

It wasn’t taken from the dem. It had been excluded from the count for some reason.

The ballot benefited the Republican. But the Democrats have a valid issue with this. The ballot should have been declared void.

evidently it was questioned by democrats but had the republican voted for. Otherwise, it wouldn’t have been awarded to the republican. The question probably was a smudge, an extraneous mark, whatever. But there must also have been strong indication it had been intended for the republican.

Sounds like instant replay in the NFL. The Democrats were dancing in the end zone, celebrating an apparent touchdown. Then the referee announced that “the play is under further review” and later that “the call has been changed.” Now the election is tied. Does the recount continue or is a new election held?
