Meh. If they were kept from entering illegally and tried to do a u-turn to escape, and were shot, the argument could be made that they were shot trying to escape the NSA.
It appears to be that simple.

Does it? Here's an excerpt from the Baltimore Sun article (link posted above:
A spokesman for the FBIs Baltimore field office said late Wednesday that investigators are examining the possibility that the driver might have made a wrong turn into the complex, but it is not the only theory they are considering.People make mistakes and get scared. There is no possible justification for shooting someone who it trying to turn around and leaeve a place they are not supposed to be, no matter how clumsily they are doing so.Injured were an NSA police officer, the driver of the SUV and a civilian bystander, said Gordon B. Johnson, special agent in charge for the FBIs Baltimore office. He said the SUV had three occupants.
We don't give bureaucrats the rights of judge, jury and executioner in the USA. Even at "Top Secret" facilities (in the middle of Maryland with 50,000 employees, it's really not that secret).
The details are not satisfying, at this point.
What you said is correct.
