It is frustrating to wait for results. Trump campaigned on draining the swamp, putting Clinton in prison. I believe he meant it and will follow through and so will Sessions.

Sessions has come to disgust me. That he didn’t see the coup coming in the name of the Russian investigation and advise Trump he needed to bow out of the nomination process is insane. What is he doing there?

AG or Deputy AG, acting or not, you implied Trump could put whoever he wants into those positions. That is a false assertion. He can only do so if the Senate approves or if there is a recess.

Once again, YOU ARE WRONG !!! You are equating ACTING AG with AG If he needed Senate approval for acting AG, then please explain how Boente was appointed ACTING AG without Senate approval.

The statute you cite, 5 U.S. Code § 3345, is for general replacement of an Executive Branch officer. If that were the only statute on the matter, you would be correct. However, 28 U.S. Code § 508 is specific to the Office of Attorney General and thus overrides 5 U.S. Code § 3345.

He fired Yates because she was clearly in defiance of his policy; she deserved it. He had no choice. But look who he got, Rosenstein. And look who Rosenstein brought.

No, he got Boente as acting AG. He got Rosenstein as Deputy AG AFTER Senate confirmation.

You suggest that he draw from the same pool to replace Sessions or Rosenstein as acting AG/Deputy AG. That’s an insane decision because it begs the same result, another swamp person to foil the President’s direction and act to impede his presidency.

Not insane at all. I am sure there are a few US attorneys out there that are not deep in the swamp. The whole point of choosing one of them is to block Rosenstein from becoming in charge. It is a temporary block until he can get a nominee confirmed by the Senate. With the Dems dragging their feet on nominations, I would rather have a US attorney in there temporarily than have Rosenstein given complete control for 3 to 4 months.

Now let’s repeat more concisely: the President can only choose Rosenstein as Acting AG or someone else in the DOJ who has been there for at least 90 days. That means the President is not allowed to “who he wants” as you have suggested.

Of course. I agree with that totally. When I said "who he wants" I was referring to it in the context of a DOJ employee. I did leave out the 90 day requirement because I thought it was nonsensical to suggest that he would appoint a US attorney that had only been on the job for less than 90 days to be appointed acting AG.

You started by misquoting a statute for vacancies and implied that Trump could ‘appoint’ who he wanted as AG or as Deputy AG, acting or not.

I never misqouted the statute and never implied that Trump could appoint the Deputy AG nor did I imply that he could appoint the AG. Here is what I said :

"Not necessarily. Actually, if Sessions resigns, Trump doesn't need approval by the Senate to appoint someone to fill the position. Under the Vacancies Reform Act, 5 U.S.C. §§ 3345-3349d , he can appoint anyone he wants as acting Attorney General. He does not have to wait for a recess appointment and Rosenstein won't become acting Attorney General. This person will have all the powers of the Attorney General, just not the title.

Acting AG is NOT the AG. The AG requires Senate confirmation. The Acting AG is not a Cabinet Office. He has the power of the AG, but is subject to restrictions. The first being that he has to be an employee of the DOJ ( whereas an AG nominee could be from anywhere - even the private sector). Plus he is subject to the 90 day requirement, can only serve 210 days and cannot be the same person who he nominates for AG.
