TRUMP SAYS IT’S TIME TO DENY ENTRY TO ILLEGAL IMMIGRANTS. CAN HE?
Powerline ^ | June 25, 2018 | PAUL MIRENGOFF

Posted on 06/26/2018 3:27:43 PM PDT by Lazamataz

Philip Rucker and Dave Weigel, two of the Washington Post’s most incorrigibly biased anti-Trumpers, lead off their latest editorial thinly disguised as a news report this way:

President Trump on Sunday explicitly advocated for depriving undocumented immigrants of their due-process rights, arguing that people who cross the border into the United States illegally are invaders and must immediately be deported without trial or an appearance before a judge.

Trump’s attack on the judicial system sowed more confusion. . . .

Rucker and Weigel are among the confused. Either that or they are hiding the ball.

8 U.S.C. §1182(f) of the U.S. Code confers on the president the power to turn away immigrants at the border. It provides:

Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate.

Rucker and Weigel do not mention this presidential power. But its existence undermines their suggestion that Trump would be denying “due-process rights” if he decided to deny entry to immigrants without granting them a trial or an appearance before a judge.

If America does not have the facilities to safely detain these illegals until due process of their asylum claims, then what do we do? Run them all into a ditch?

I say yes.

German illegal immigrants swamped across the following borders:

Poland in 1939
France in 1940
Russia in 1941

North Korean illegal immigrants swamped across the South Korean border in 1950.

Pancho Villa and his band of illegal immigrants swamped across the US border in 1916, requiring a response across the Mexican border by the US Army (NOT the Border Patrol).

Border Security is a MILITARY PROBLEM, not a LAW ENFORCEMENT PROBLEM!

The US can repulse the invaders short of the border.

...Build the wall...
And everything else, including lunatic liberal whining, crying, and screaming become moot.
Except for the whining, crying, and screaming about the wall existing.

...8 U.S.C. §1182(f)...

This is the same law that the President’s SCOTUS win was based on today.

“That’s not the same as saying the US can turn back border jumpers. Once on US soil, they have due process and equal protection. The President can shut the legitimate entry points.”

Really? So these people KNOWINGLY violate our law to get here. They plan to go under, over and through various physical barriers to get here. They get one foot over the line, and that’s WHAT, a touchdown? All the laws mean nothing? The effort that we’ve made to keep them out come to naught - now they have rights, just because they were ever so slightly more successful or ingenious in defeating our laws and our barriers than the next illegal?

BS. There has to be some court (hopefully the Supreme Court, even if after Trump replaces a Leftist) that will say that the fact that someone merely gets here is a legal technicality of no effect - that they are NOT US citizens or legal residents and, as such, they have NO RIGHTS to Due Process here.

They’re not immigrants. They’re foreign nationals.

Yes he can. He’s keeping us safe! The dems would rather have us killed than support Trump’s sensible actions.

Give them a copy of the 2nd amendment and constitution. Send them back. Tell them to figure it out. First, your effed up rulers/overlords/reprsentatives have to die.

Yes President Trump can.

It’s called the law.

If Leftist do not like it, then change the law.

ANY individual ILLEGALLY crossing into the United States LOSES their right to claim asylum!

Dear President Trump, JUST DO IT.

Well, the key phrase is “due process.” It’s not due them. Far as I know, if you overstay your visa in other countries, they just pick you up and kick you out.

Why do they have due process once they are on US soil? I am not clear on this.

Trump has all sorts of authority he fails to use.

For instance, dozens of documents are under subpoena or FOIA requests at the FBI and DOJ which concern the Russia Collusion farce.

DOJ and Sessions just ignore or stonewall those requests.

Trump could order those documents to be declassified and released immediately. Instead, Trump does nothing.

Trump could end DACA instantly with an Executive Order to deport every DACA kid, which would be based on the exact language in the Immigration Act of 1965.

Instead, Trump has wasted an entire year trying to declare DACA unconstitutional with an Executive Order.

Trump could have stopped Obama’s “Catch and Release” immigration policy on his first day in office.

Instead, Trump enforced Catch and Release until May 2018.

Because the courts have long said so.
