The McConnell Rule is law and Senate Democrats should sue to enforce it

This week, President Trump will announce his nominee to replace Justice Anthony Kennedy on the United States Supreme Court. Senate Majority Leader Mitch McConnell has promised to schedule the nominee’s confirmation hearings for this fall, before the midterm elections.

If and when McConnell carries through on this promise, Senate Democrats should immediately file a federal lawsuit against him for violating the so-called “McConnell Rule.”.....

Lol! I love the desperation of the liberals on this. The sad thing is they could probably find some kook Obama appointee Federal Judge somewhere that would gladly agree wholeheartedly and issue an injunction....

No. Next month. The President's choice will already have been confirmed by the Senate once for the seat that he holds now. The posted piece is hysterical.

It was not just a presidential election. It was at the end of an 8 year term where there is no possibility of re election. At the time it was a foregone conclusion that Clinton was going to be elected so it was not holding out for a republican.

With all due respect you miss the point. If the Rats pulled this off the SC would be 4-4 until the congress is seated next year. Renegade Judges will block Trump at every turn until then. The 9th circus can set precedent in the meantime.

So under this argument, no Judicial nominees can be confirmed during the second, fourth, sixth or eighth year of any presidency.

“Ken Levy is the Holt B. Harrison Professor of Law at Louisiana State University’s Paul M. Hebert Law Center. ”. Someone at LSU should rescind his legal credentials after the claptrap he wrote in this article. Senate rules and laws are very different.

Sue, Sue, Sue. The democrats know that any law suit no matter how zany can buy time. If they can bring the case before one of the many Clinton/Obama judges, they can stall long enough to get past the election and somehow win enough seats to jam up supreme court, impeach Trump, deal with Pence, win the house, etc, maybe they can stop the destruction of all the socialist “progress” made over the last half century.

Yeah, for the past couple of weeks or so I've been amazed at the number of articles from The Hill that have been posted here.

I looked at a few, and The Hill is still The Hill.

This one falls in the same category.

It's The Biden Rule.
