Could Barack Obama Become President again as Speaker of the House?

The XXII Amendment to the Constitution says, in part, "No person shall be elected to the office of the President more than twice, and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of the President more than once."

Notice what this Amendment prohibits: "No person shall be elected to the office of the President". It says it twice.

Notice also what the Amendment does not say: "Any person having served blah, blah, blah shall be ineligible to the office of the President".

If the Democrats take the House and elect Obama as Speaker, and then manage to remove the President and Vice President (by whatever means), would Obama's succession to the Presidency happen by him "being elected to the office?"

I don't think so.

The Amendment only prohibits a third term that happens as a result of an election (which, BTW, is not in the Constitution to begin with).

A person who previously twice was elected President can serve at most two other years as President. Therefore, were the Congress so inclined, it could impeach both Trump and Pence during 2019 and elect Obama Speaker of the House, and he could ascend to President to complete the remainder of Trump’s term. Article 1, Section 2, Paragraph 5 only says that the House of Representatives shall choose its Speaker. It doesn’t require the Speaker to be a member of the House of Representatives.

That wont work. The rats thought about putting Billy Jeff back in office that way, but...

"The vice-president must be qualified to be President. According to the twelfth amendment of the Constitution, "no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States.""

Bubba shot his wad, so to speak, with his election to the Presidency.

Bill Clinton is no longer eligible to hold the office of President so he is ineligible to be elected to the Vice-Presidency.

Clinton is NOT “constitutionally ineligible”.

He is barred FROM BEING ELECTED again.

As far as his constitutional eligibility, he is >35 years old, he was born in Arkansas, and he has had legal US residence for the past 14 years.

You present an interesting, if far-fetched, hypothetical. And as you noted, the 22nd Amendment talks only about elections. I wonder why it was framed that way. They really should have said something about “serving as President” to close the loopholes.

Anyway, consider this only slightly less far-fetched scenario. The 22nd Amendment makes no mention of the Vice-Presidency. It’s 2020 and Hillary gets the Democrat nomination, again. She picks Obama as her running mate in an attempt to boost the black voter turnout.

The House can’t remove the president. It must be done in the Senate after being passed from the House.

Read the Amendment.

It does not disqualify anyone from anything.

It says "no person...may be ELECTED more than twice".

Now, this presupposes the existence of Presidential elections, which are not required by the Constitution and which any State is free to do away with at any time.

Read broadly, I suppose, the Amendment could be a restriction on the Electoral College, since what they do is a sort of an election.

But however you read it, the affected persons are the ones who do the choosing, not the one who is chosen.

They could have easily amended Article II and Amendment XII by saying, "No person who has served two terms shall be further eligible to the office of President..., or, "Any person who has served two terms is subsequently disqualified from serving as President..", but they did not do that.

Amendment XXII only restricts becoming President through the mechanism of being elected.

Pence would be able to name a new vice president long before the Dems. could impeach him, and they would have to impeach the new guy who also would have selected a new vice president. It’s a never ending circle.
