After days of being dressed down by the judge overseeing the Paul Manafort case, federal prosecutors sought Thursday to put their foot down -- filing a motion complaining that Judge T.S. Ellis III had unfairly admonished them in front of the jury.
Ellis has memorably and repeatedly criticized Special Counsel Robert Muellers team during the trial for the former Trump campaign chairman. On Wednesday, Ellis ripped into prosecutors for letting a witness, IRS Agent Michael Welsh, sit in the courtroom before his testimony.
But in a five-page motion filed Thursday, Mueller deputy Andrew Weissmann and other attorneys on the team claimed Ellis had actually granted permission earlier in the trial for the witness to remain in the room during proceedings.
The courts reprimand of government counsel suggested to the juryincorrectlythat the government had acted improperly and in contravention of court rules, the prosecutors wrote. This prejudice should be cured.
Ellis responded by expressing regret in court Thursday.

I don’t quite understand this. It’s completely fundamental that you do not allow witnesses to sit in on procedings that occur prior to their testimony. Very simply, you don’t want a witness who is ready to testify that he/she saw “X” hear a prosecutor say they are ready to prove “Y” 2-3 times before they testify. You just don’t; it’s too easy to pollute of subtly influence the testimony of the witness. Why Judge Ellis would have allowed this is unfathomable.
Now Mueller wants to go after a federal judge?! Good luck, scumbag.

Well that’s an excellent question, but again we aren’t hearing that Ellis denied it either. Could this have been something a flustered Ellis actually did grant? But again, even a belated motion for a retrial would seem to make sense here.

In “cross” Mannafort’s attorney will ask the witness who was in the courtroom while testimony was being given if he or she was in the courtroom and did they hear testimony being before they were called to testify. They will answer yes. Mannafort’s attorney will turn to the Judge and ask that any and all testimony given by the witness who was in the courtroom be stricken from court records and request the jury be instructed to disregard that testimony. Watch Mueller’s head explode!

If this creep is on the prosecutorial team, there is no criticism of them by the judge that would be over the line (IMHO).
